Closer to 2% are intersex, so over 160 million people, over 6 million Americans…and they have rights. Brain chemistry and architecture create unmodifiable (with extremely rare exceptions) gender. Physical traits are modifiable, so if they determine gender to you, by definition you believe gender is fluid, invalidating your own arguement.
