On March 5 at about 10:00 PM, ten heavily armed FBI agents, accompanied by three local police officers, stormed into the home of an American family and arrested a 16 year old boy on charges he made numerous bomb threats.
The boy, Ashton Lundeby, was taken from his family's North Carolina home, to a juvenile facility in Indiana where the threats were allegedly made.
During the raid, the FBI executed a search warrant and thoroughly searched the family home. They found absolutely nothing illegal or suspicious. No bombs, no bomb-making material or anything unlawful.
It turns out, someone hijacked the family's internet IP address and used it to make numerous phone calls and terrorist threats.
The family has been told they have no rights to see their child and, under the USA PATRIOT ACT, the child has no rights to even defend himself. They claim the Constitution does not apply to this 16 year old, natural born, American citizen. - youtuber

with habeas corpus ashton would have the RIGHT to hear what evidence the FBI had against him.
the PATRIOT ACT gives the FBI authority to negate habeas corpus,strip ashton of that fundamental right,deem him "enemy combatant" and hold him indefinately.
all without EVER having to reveal the "evidence" in the name of "national security".

Mashikisays...Oh look. An incompetent judicial system, that doesn't understand current technology. Allowing warrants without the full information, leading to a situation where it 'may or may not be'. Along with the how, and when it is abused by people, criminals, and other unsavory elements of the population.
Maybe, just maybe, people shouldn't be shocked at this. On the other hand, perhaps they should be pressing that their judicial system be held accountable to massive failings, and screw-ups like this. I await the time when patriot act is used, and it leads to a printer in an office building. After all, the proof of concept has already been proven.

trenielksays...This is wrong. Even if the kid did everything the government said, it's still wrong. We have due process in this country to deal with situations like this and determine guilt or innocence.
To me it looks like a test to determine if we are willing to let it pass as a necessary part of keeping us safe. From my point of view, it is a test we are failing miserably. This is the kid down the block, the neighbor right next door and this is the family it couldn't happen to in this country. Yet it has happened. And guess what, it will keep happening. Especially if we do nothing to try and stop it.

I'd like to think that a few weeks from now, people will not be referencing this case as a failure of the PATRIOT act, but I'm not optimistic. While there's plenty of reason to criticize it, this case is not one.

The second I saw this I thought to myself, "Wait for it..." There are law enforcement abuses like this that go on ALL the time. It isn't anything to be proud of, but it is an almost inevitable outcome of simple human nature and logistics. In time if this kid REALLY has nothing to hide he will very likely be vindicated. In the meantime the family is on the receiving end of a crap sandwich. It's a bummer, but it happens.
But of course, it isn't surprising to see the blogosphere glom onto this story, fallaciously tack "Patriot Act" at the end of it, and use it as an excuse to inject a fresh dose of Bush-Hate crack into their jugular for their daily fix.

After reading the wired.com article I'm thinking this kid is probably guilty, and if so, he deserves to be punished.
