habeas corpus was a british law dating back to 1250 a.d.
a powerful,fundamental right of a citizen to face his accusers and ask "why"?
under the new legislation thinly disguised as the made-up "war on terror",fundamental freedoms are suspended.
all the state has to do is deem you "enemy combatant".

thats the POINT!
with habeas corpus ashton would have the RIGHT to hear what evidence the FBI had against him.
the PATRIOT ACT gives the FBI authority to negate habeas corpus,strip ashton of that fundamental right,deem him "enemy combatant" and hold him indefinately.
all without EVER having to reveal the "evidence" in the name of "national security".

Oh look. An incompetent judicial system, that doesn't understand current technology. Allowing warrants without the full information, leading to a situation where it 'may or may not be'. Along with the how, and when it is abused by people, criminals, and other unsavory elements of the population.

Maybe, just maybe, people shouldn't be shocked at this. On the other hand, perhaps they should be pressing that their judicial system be held accountable to massive failings, and screw-ups like this. I await the time when patriot act is used, and it leads to a printer in an office building. After all, the proof of concept has already been proven.

And the US earns yet another enemy - a 16 year old (possibly) innocent who will spend the rest of his life distrusting and doing what he can to deprive his government of their ability to suppress him. Or at least he _should_.

This is wrong. Even if the kid did everything the government said, it's still wrong. We have due process in this country to deal with situations like this and determine guilt or innocence.

To me it looks like a test to determine if we are willing to let it pass as a necessary part of keeping us safe. From my point of view, it is a test we are failing miserably. This is the kid down the block, the neighbor right next door and this is the family it couldn't happen to in this country. Yet it has happened. And guess what, it will keep happening. Especially if we do nothing to try and stop it.

Write your congressman, link the video to your friends. Spread the word you think this is wrong.

I'd like to think that a few weeks from now, people will not be referencing this case as a failure of the PATRIOT act, but I'm not optimistic. While there's plenty of reason to criticize it, this case is not one.

Since when did that matter to people who let blogs with which they are politically sympathetic do their thinking for them? The second I saw this I thought to myself, "Wait for it..." There are law enforcement abuses like this that go on ALL the time. It isn't anything to be proud of, but it is an almost inevitable outcome of simple human nature and logistics. In time if this kid REALLY has nothing to hide he will very likely be vindicated. In the meantime the family is on the receiving end of a crap sandwich. It's a bummer, but it happens.

But of course, it isn't surprising to see the blogosphere glom onto this story, fallaciously tack "Patriot Act" at the end of it, and use it as an excuse to inject a fresh dose of Bush-Hate crack into their jugular for their daily fix.
