Man cleared after video shows he did not batter officers

After a beat down in an elevator, Joshua Daniel Ortiz ended up with his nose broken and facing a charge of battering a Fort Lauderdale police officer.

The 22-year-old Sunrise man was surprised and delighted to learn Wednesday that Broward prosecutors were dropping the case against him after reviewing an elevator surveillance video showing three officers aggressively rush and beat Ortiz to the ground. -Article

On a side note, I wonder how this would be handled if the kid threw a punch back. Would he sill be charged? If a cop throws an unprovoked punch at me can I defend myself or do I have to curl into a fetal position and say "Stop officer friendly!"

Are you watching the same video I am? At wrost it was a confrontive chest thrusting, which sure, can annoy the crap out of a cop, but the skin head mob reaction by ALL the cops suggests there's something pretty sick going on in that precinct.

There are plenty of those vids out there, mostly from Spike TV and TruTV shows.

Cop 1 & 2 ought to get sued for assault. The other cops should have stopped them more aggressively, but chose to be "loyal" to the other two, which as far as I'm concerned makes them accomplices. The Police Academies should teach them that a cop's loyalty is not to other cops, but to the law.

The police force needs to be purged of these bad elements, because they demean our whole idea of law and fairness.

Technically the guy did assault the cop. He hit him with his chest, so yeah he could have been charged. Now the cop totally over-reacted and the other cops seem to just be throwing punches.

They only dropped charges hoping the guy won't sue. (If they went in front of a judge and he saw that video the thrown out criminal charges, plus discovery would help his civil case, this way it will be very expensive to try and sue the cops)

There is no way you can defend yourself except covering your vital body parts and even that could result getting hurt even more. There are too many videos out there that shows that even the basic reaction of curling into fetal position can get you tasered..

Well, he can be charged whether he did anything or not. Given the corroboration of 3 or 4 upstanding fellow police officers, he can be convicted.

Unless there is a video.

Only in bizarro world could this be considered assault. Clearly the prosecution agrees. Or the tape got released.

Statistics show that crime rates are higher among cops than among the general population. The job attracts the wrong people. I guess it has been that way since "Gangs of New York" days. The culture has to change so that more decent people stand a chance as a police officer and want to be one to begin with. I say start with more restrictions and scrutiny than the general public. Being a representative of the law should mean you have to be held to a higher standard not a lower one. Many will complain but only with drastic change will the job attract the right people.

How about filing charges against the cops. Assault and perjury should lock them up for a long time. A lawsuit won't punish the cops at all.

Guy had his hands in his pockets. As for other cops with measured response: There aren't enough of them to stop the crappy ones so I think your ratio is way off. Even though cops get away with murder and many other crimes they still have higher rates of criminal convictions than the general population. Honorable people would rather volounteer as a firefighter (more dangerous, better culture) than become a police officer. The whole police culture needs to change in order for the right people to even want to apply. As long as the people in charge punish cops who try to do the right thing and protect the fucktards who are there to get away with things and feel powerful how are things going to get better?

And people being dismissive of the problem doesn't help either.
