Gamblesays...Judge Napolitano is actually a pretty level-headed guy. Just about any show on Fox that he gets called into talk on, he often presents damn good points. It's a shame they give Glenn Beck a show but this guy gets mere tidbits.

Have you ever seen a dead tree? Often you can see a dead tree still standing in a forest. Squirrels running up the tree, birds flying in and out etc.
But the tree is dead.
Much like the spirit that can produce a 1st Amendment; that spirit is dead amongst the analog class of Americans in modern times to the class of folks who gave us the 1st Amendment way back when.
The folks in charge now would not come up with a free republic if they had the opportunity to start from scratch today. We have the structural remnant of freedom, but the life force that animates that freedom is gone, at least among a certain class in America.

True that he isn't American, but I would've hoped that a government of a country that has a constitutionally-enshrined free press wouldn't seek to censor a press source from any other country that comes into posession of leaked documents. In other words, one would hope that the American government would respect their own constitution enough to consider its fundamental protections to be universally applicable.
Xaielaosays...This entire situation also proves that in the US we basically have no free press anymore. Besides the Times and a few other news organizations, the US news media is entirely bought and sold by corporations and the government itself.
The government really has succeeded at the impossible by all but completely subverting the Free Press in this country and the outrage over Wikileaks by many of the major news outlets just goes to show how everything they say is controlled by the corporations that own them. Most of the 'news' we have today is just sensationalism and subversion. The title of this very video is an example of that. Just like with the Pentagon Papers, which exposed that the pentagon had provoked an attack on US vessels by the North Vietnamese and then lied about saying the attack was unwarranted in an attempt to swing public favor to those who wanted a war. Sound familiar?

I think that's pretty clear, there, that it doesn't matter whether someone's a citizen or non-citizen. Freedom of the press shall not be abridged.
The Constitution actually makes pretty infrequent use of the word 'citizen'. AFAIK, the Constitution applies to all people under the jurisdiction of the government, and that there've been supreme court cases that have concluded this (I could be wrong, though, 'cuz I'm too lazy to go hunt them down). Assange, as a non-American not on American soil, doesn't get the protections granted to *people* until they get him here, I suppose.
But the freedom of the press definitely isn't targeted at only citizens or even only people. Congress shall make no law abridging the freedom of the press. Very straightforward.
And this is why they're trying to name him an enemy combatant or a terrorist, and not a member of the press, so they can pretend that this is an exceptional case and that the Constitution can be circumvented, that he can be assassinated, etc. Because they have no real legal leg to stand on.
