Nurse Arrested For Not Taking Unconscious Victim's Blood

A nurse alleges she was assaulted and illegally arrested by a Salt Lake City police detective for following a hospital policy and the law that does not allow blood draws from unconscious patients.
Footage from University Hospital and officer body cameras shows Detective Jeff Payne insisting to nurse Alex Wubbels that he be allowed to get a blood sample from a patient in the burn unit who had been injured in a July 26 collision in northern Utah that left another driver dead. The patient was a truck driver hit head on by the deceased who was running from police, not a suspect or perpetrator.
Wubbels responded that blood cannot be taken from an unconscious patient unless the patient is under arrest, there is a warrant allowing the draw or the patient consents. The detective acknowledges that none of those requirements is in place but insists he has the authority to obtain the draw. This clearly enrages Payne, who violently arrests Wubbels in full view of other officers for "obstruction".
Payne's superior has expressed concern, because Payne was in the wrong and had no reason or right to arrest her, but oddly the excessive force of the arrest is not an issue for him.

It's the violence of the arrest that gets me.

She didn't know her rights or obligations on the spot. She went with her best interpretation of the rules she had to hand, and it seemed reasonable from the footage we have.

Maybe they could arrest her on the basis that they knew or believed she was in the wrong, but I believe she could/would have gone willingly if it was handled rationally.

If the default position of the police is adversarial, you're going to have a bad time.

Truly sad. She is doing her job and following all the rules, but because the detective threw a temper tantrum she gets arrested. This is the equivalent of a parent telling a child they can't have something just because they want it and then the child abusively locking up the parent.

This guy should be fired, there is no excuse for someone with clear mental issues to be in charge of other peoples lives and freedom.

Actually, she did know them, and printed them out for his education. He didn't know the laws changed long ago and that he had no right to demand the blood, and he didn't understand that her refusal would never have been obstruction or a crime even under the old laws where he could take the blood.

He definitely frenchfried while he pizzaed.

Update: He's now on paid vacation while they try to save his career.

Because... you know, the police don't have enough of an arsenal at their disposal already.

What does a society do when the police are the criminals and they refuse to enforce the law on each other?

Fuck that, I don't want them to have further training either, that way I can always hope he points it the wrong way and blows himself up.

this is insane. Shopfloor nurse with print out of policy. If she took blood for non medical reasls without consent then she could be arrested for assault and battery.

So it gets worse.

The person they wanted to draw the blood from is a reserve police officer himself, was not even a suspect in the crash, and only got involved in the crash because the other driver was a suspect fleeing from pursuit by other officers.

So they didn't even need the blood really.

Both the detective and his supervisor are suspended on admin review because the detective said he called his supervisor and was told to arrest the nurse.

If he really received those orders from his supervisor then it's pretty scary still that this fuckface did not have the common sense/decency to question that order when it was obvious the nurse was following protocol but was also stuck between policy & navigating an unfamiliar situation.

I sentence the pig to 6 months in a mental health facility and 2 DMT injections a week to diffuse his ego & expand his consciousness (and maybe he goes to hell once or twice).

Yeah, it is still no excuse for him to go through with the order. Better to take a suspension for doing the right thing than to take one for just following orders. Plus you can easily tell the detective was throwing a tantrum even if his supervisor did tell him to arrest her.

Every aspect of the police's behavior in this video is wrong, but what is the most disturbing is how they tell the nurse if what they are doing is illegal the courts will rule on that later after they have what they want and use it against the suspect. This shows the insidious nature of the heinous low levels which the abuse of power operates on.

It bears noting that this happened in July, but no action whatsoever happened until she made the video public in late August.
It's pretty clear they thought this would go away like all the other abuses of power they swept under the rug.
