Retarded. How about, ask the kid? I admit to the *possibility* of it being "rape" but what freaking 13yr old GUY isn't fired up and ready to go half the time already? Ya can't rape the willing. No amount of "he's to young, she coerced the poor innocent!" will sound very convincing either.

Statutory rape is about a minor's inability to consent. It's not that he isn't willing, but that he might get a messed up perception of what sex is all about for the rest of his life. At least, that's the theory. I'm not sure exactly what negative effects it could have, but I'm not a psychologist.

Yeah we draw a line at 18 (or 16) stating that after such time you should be better equipped to make these decisions. I was just as stupid at 13 as I was at 18, so not sure how much it matters, but it's kind of a law of percentages deal.

Granted a 25 year old man seducing a 13 year old girl will likely cause more damage BUT a 13 year old boy learning about forming relationships, physical affection, sex all from someone who has way more power in the relationship with him will fuck up his relational and sexual development guaranteed. At first it'll be something to brag about but 5 years down the line is when it'll not seem so great in retrospect unless he's exceptionally emotionally healthy to start with. Pubescent boys fantasize about sexual encounters - not the weird she's-15-years-older-than-me stuff that's around it afterward.
