US Border Patrol tries to take passenger's camera

"The checkpoint is an hour from the actual border and is NOT to catch illegals like they would have you believe.

It's about pirating and making cash. Ask yourself...where does all these drug confiscations go? Do you ever see where it actually goes? The answer is NO We need to get rid of this fantasy that the government is working for us....they are for-profit corporation

This is not some random checkpoint and the Illegals are not that freaking stupid to go to a checkpoint which is known by ALL. " [from youtube]

Wow, the y/t poster is a paranoid moron. He should try reading the law as to how/where CBP are allowed to operate. And if he doesn't like it write his reps or run for office. Since the checkpoint is inland, he would be fine then with the local SO or State Police running it? Or maybe the FBI or military? And an illegal working for CBP? Nice try.

I know there's a lot of anti-establishment, the cops are always wrong, we live in a police state mentality here, but don't get too paranoid folks. The cops aren't always wrong, sometimes they need to use force (but F tasers), we don't live in Nazi Germany, and we should be vigilant in keeping government in check. But harassing these guys is like harassing a Walmart greeter because you don't like their policies. Dick move.

As for the whole camera thing, who cares if the guy has a camera. Do your job, and don't be a dick about it. Although, my instructors old us not to advertise that we were BP Agents and try not to have pics taken...since some cartels have bounties out for killing Agents.

You've not been inconvenienced by them have you? Their searches are haphazard, and they cause massive backups on the road for miles. They make a bad situation worse, and fuck that. You have the right to tape any fucking peace officer you wish. Paranoid or not. They should be afraid of the US citizen we should not be afraid of them. The moment he reached his hand into that car he violated the 4th ammendment.

Seeing as to how the US citizen did not have anyone there to save his ass I think he was quite in the right to do what he did. You reach your hand into my car without proper protocol you may come back with a stump. The video proves that the cop did not have Probable Cause to enter the vehicle ergo; he should be removed from duty as he is a danger to the public.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

They're both being dicks here, but the key point as said above is that ordinary rights given by the constitution are not being *upheld* by someone that is in the very position to make sure it does!

littledragon_79says...

Inconvenienced, no...I was one of "them". And when I lived in San Diego I never went north of Carlsbad, so I didn't have to go through the San Clemente checkpoint. You are right on reaching for the camera, not cool.

There are some different rules regarding searches at the border, but this is obviously a checkpoint not at the border so there are enhanced requirements. Quick article on border searches.

If this guy (or anyone - hint, hint) wants to do some good, go out and collect signatures and get the thing de-funded and/or closed down.

Uh, what just happened there exactly? The tyrannical guards didn't want to be filmed and then sent him on his way without seeing any papers or anything? I've driven through the US a lot and never come across any checkpoints like this. I presume maybe they are along the Mexico border? Either way, this non-incident didn't quite seem like an outrageous abuse of power from what the video showed. I'm confused, what was supposed to be the point here?

The y/t poster is paranoid. I doubt the border patrol agent is "illegal", though that's incidental. First, BP are nothing like Walmart greeters. That's a bad analogy. Harassing someone who wants to keep you from freely moving in a supposed free country and trying to steal your private property is nothing like harassing a gentle underpaid elderly woman saying hi to everyone entering Walmart. The BP are pests and abuse their power constantly.

And, yes, we do live in a police state once the government recognizes it has a right to kill its own citizens without due process. There's nothing paranoid about noticing the increased security measures that encroach on our liberties, or states forcing subversives to register, or little 12-year old girls being marched out of class wearing handcuffs, or the countless cases where law enforcement destroy videotape evidence, or the endless beat first ask questions later cases, or local and state police being supplied military weapons by the Pentagon, or being arrested for videotaping officers, or the use of sedatives on the public by police officers.

That's just to name a few.

I am downvoting that shit.

Really, they come to a checkpoint and act like dicks right off the bat with the only letting the window down as little as they can and then are FUCKWITS in trying to suggest the guy is an 'illegal alien' because he has an accent? Please. Fucking racist shits right there.

Sorry, but THESE are the sorts of fucks who arm themselves to the hilt and are racist and bigoted against anyone who is remotely different to themselves.

They go out of their way looking for trouble, fuck I hate dicks like this.

The checkpoint guy should not have put his hand in, but these guys are doing all they possibly can to incite problems... shitheads.

True, the "illegal" comment is most likely bogus and certainly lame. They may be racist bigots, but that's incidental to what happened here, right? Even if these guys pulled up to the check point wearing KKK robes, it still doesn't detract from the problem at hand. It's simply incidental.

Also, whether or not they arm themselves to the hilt is incidental, as well. They have a right to bear arms. You can't condemn them for their rights. Still, where in the video did you see them pull out a weapon or even threaten violence? No where.

The only person being threatening is the BP by reaching in and trying to steal or break the camera. Filming him is NOT inciting a violent behavior; it is simply a documentation of events. The BP is a public servant, and there should never be a problem with filming a PUBLIC servant.

The border patrol are set up miles from the border. They're stopping anyone and everyone and a lot of them are abusing their powers, and more importantly, if this whole scenario doesn't smack of "your papers, please" then I don't know what does.

Comment hidden because you are ignoring dag.(show it anyway)

Spocko- I can understand your reaction- but you really have to experience one of these checkpoints. They are often hundreds of miles into the interior of the US (not on the border) and they stop you- look you over and then ask the equivalent of "you got any Mexicans in your car?" (though carefully not in those words- but that's the intent).

It's disgusting and unlawful. Would it be wrong to be obnoxious to the Stasi East German police? Because this is in that category.

Blanky, I hope you're not a secret teabagger that would scream bloody murder about not protecting our borders if the checkpoint was closed...and in the same sentence say that we need to limit government. You'd have to run the numbers, but closing some (or all) of these checkpoints could save a lot of money and end a lot of frustrations. Maybe I'll ask some folks still on the job what they think.

blankfistsays...

@littledragon_79: I'm not sure what a secret teabagger could be, but if you're trying to paint me as a Republican who is waving the "Don't Tread on Me" banner temporarily and only for as long as the Dems have majority, well, I'm certainly not one of them.

I believe in open borders. I think we wouldn't need to "protect" our borders if we didn't go around the world pissing everyone off by maintaining and spreading US hegemony. I think the fear surrounding open borders stems from two similar positions: one, that by doing so we'd all lose our jobs to immigrants which is silly fear-mongering to me; and two, that freeloading immigrants would be a strain on the system. I agree with the latter, but the remedy is to not close the borders, but instead simply get rid of the welfare that can and would be exploited.

Matthusays...

Better to keep them out for now until you can wrest, from the hands of the thieving and controlling ultra-rich, the billions of dollars in capital it will take to afford these immigrants jobs gainful enough to provide them shelter, food and health care.

If you get rid of welfare and open the borders to people wanting to leave their country to go to America, likely due to economic difficulties, what I think you'll end up with are sick, destitute, hopeless, homeless humans dying in your streets.

You wouldn't like the smell.

P.S. That doesn't excuse the asshole who abused his position of power to invade the personal space of one of the citizens he is meant to serve.
