Federal Income Tax is illegal, and Americans need to know.

Well, I sat down and watched "Freedom to Fascism" last night, and I couldn't believe it. Every American needs to watch that documentary. I'm not going to go into a huge spiel here. If you want to know more, you can watch it for yourself. Federal Income Taxis illegal? You bet. It is absolutely dumbfounding that our government gets away with what it does. To think that every citizen in the nation is paying income tax when it it completely illegal and against the Constitution. You need to watch this documentary, then write your congressmen and suggest it to them as well. After watching the movie, My friend and I got to talking about social security as well. So far we have not been able to track down anything saying that we have to pay it either. Actually, by definition, it to is illegal. Anything you pay into social security does not come back to you. It actually goes into the general fund, thus making it a tax. And any direct tax on your wages, is illegal. So if anyone can find me something saying other wise, I'm going to call SSA to get a refund.

[Edit] Heres what the US Constitution has to say about direct taxes.
The 9th Amendment on Income tax - "The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration." Technically an Income tax is a tax on business. You do not make an income. You make wages.

This is common knowledge, but people react to the idea of tax revolt like anything else that the mob rule dictates....they treat those who stand up against the income tax as insane, and the media will blackball the individual with balls enough to fight the status quo, with derision, and use them as an example....

Do not think that ANY display of self-actualization in the form of going up against the Government will be tolerated.....the government of the U.S. is a symbol of control, of centralized power, and impeccable. They may, should you chose not to pay your taxes, never find you.....

They WILL, should you encourage others not to do the same, ...Destroy you.

If the entire nation did not file their taxes, they would be fucking powerless.......see how that works???

Better to shut up and disappear, at this late stage in the game.....too many idiots around who live in fear.

Well I thank you for trying. Maybe you can "blow your wad" on me later. Well the fact is right now Americans are on the way to fearing their government. The Government should fear the people. Think "V for Vendetta" As far as going up against the government, all we can really do is try to spread the message. S0 far my friend and I have it to about 2 or 300 people, namely the spouses of everyone in my battalion. I plan on filing for my taxes and submitting a request to pay them at the end of the year, rather than file for refund. Then i simply don't file.

google for at least 10 minutes for opposing opinions, rather than getting all excited about a documentary. there's plenty of weight on the other side of the debate. basically it doesn't matter how you debate the definitions of certain words, income tax is a fact.

let us know how it goes with your protest. maybe they got internet in JAIL.

Well, I don't know if you've seen (or care to see) the documentary but people did not file their taxes (which also has NO law stating you must) and walked out of the courthouse victorious. This, my friend, is called precedent.

Well thank you Thylan. I can only hope you'll help spread the message. Remember, remember, the 5th of November, and all the rest of that. Seriously though, this is important stuff. Even if it doesn't change in 25 years, people need to be aware. Americans need to take back their government, and reestablish our Constitution.

This always makes me laugh. The Supreme Court has ruled repeatedly that personal income tax is not a direct tax, and thus is perfectly legal. Given that SCOTUS has the final say on what is and is not constitutional, that is pretty much the end of the argument.

IANAL, but I think the difference is that income tax is a tax on a transaction, whereas something like property tax would be a direct tax. But it doesn't really matter what I think -- the point is that SCOTUS has already decided the issue.

Regardless of pure legalese nit picking, are you really suggesting you shouldn't be paying taxes?

Should you not be paying to the country in order to provide social welfare, healthcare, education etc. etc.

I know that the US has an abysmal healthcare, and welfare, oh, and education too for that matter, so there are HUGE areas in which the SPENDING of tax dollars should be improved. But cutting down on tax? Not the answer, if you can afford it then you should pay for the country to provide free education, healthcare and welfare to those that need it, it's what makes for a strong country.

Any tax that is paid to the "government" directly is a "direct tax". According to the US Constitution, a "direct tax" has to be apportioned to the states. The 16th Amendment supposedly changed that. It moved the income tax from a direct tax to an "indirect" tax, and both the Brushaber and the Stanton case, the SCOTUS said that the "income tax" was an indirect tax on "gains and profits from labor or other corporate activity." That's is the meaning of "income" in the income tax". It is supposed to apply only to "gain" from corporate activity. Your wages or receipts for your personal labor is not "taxable income" unless you work directly for the Federal Government, live in a Federal Zone, receive overseas income, or live overseas and receive income". These are activities that are under the direct jurisdiction of the Federal Government.

One more thing, the amendment you refer to as the 9th amendment is actually the 16th amendment, passed in 1909 so all of us could be forced into slavery by the bankers.

"gains and/or profits from labor" is the same thing as a wage. If you labor for money, that's a corporate activity. It's been decided long ago that's what is meant there, and they aren't limited (as you claim) to corporations and federal workers. The courts have decided this issue, layman opinions have no bearing on it at all.
Some people may nit pick at terminology to try to argue against the legality of 'taxes', but I bet you'll find 99.999% of those people still pay their income taxes, they just try to convince YOU not to, at your own risk.
