That ought to make an interesting argument if such a charge ever gets to court.
pyrexYeah, charging the "guy in question" as being responsible for the deaths of the reporters/pilots would be.. a whole new can of worms. Sure, he's responsible of [X number of crimes], but being responsible for the deaths of two news choppers colliding? Doesn't sound very likely.

silvercordHoly crap! When the woman reporter is saying "We don't know what just happened. . . " you can hear the chopper reporter screaming to his death. That's just horrific.
In addition, why in the world is he up there reporting anyway when she just kept talking over his report with her own report on the images? She's insufferable.

seriously? if anything, we see the death of the camera... period. it is NOT a video OF a death. did you see anyone die? i didn't. i saw some jerknut running from the cops, and then static. get over it.

ravenOne vote for not snuff... as I've repeatedly said, in order for it to be snuff, the video needs to have been produced with the intent of capturing a death on film, and somehow profiting from its distribution. This was a horrible accident, no doubt, and also hard to watch ifn' yer sensitive to stuff like that, but, in my book... not snuff.

jonnyI'd hardly call this snuff compared to some other things sifted which have never been questioned as such. (That being said, I probably didn't need to see it.)
As for the pursued suspect, I think any possible charges in relation to the helicopter deaths would be classified under 'felony murder'. In many states it is often legally equated with 1st degree murder, regardless of intention or circumstances of death (outside of attaching causality of the death directly to the actions of the accused). That last bit is key - as a couple of folks pointed out, you would not likely be held responsible for a person dying of a heart attack because they were shocked by how fast you drove through an intersection while evading capture. However, if you ran someone over while evading capture, even if they were "not in a crosswalk", or even if you simply caused another car to run someone over due to "reckless driving while evading capture", you're hosed.
InvaderSilSo the tragic race car accidents that are caught on tape can get pulled but this people vote to keep? I guess my use of "snuff" was the wrong category. I should have said death instead.
No matter as it is apparent that it will be not worth the effort to attempt to sway anybody on changing their position on this. *return it to where it came from...
