As far as assault, I'd love to see them trying to lie in front of a judge the reason they had the phone. Then roll the video and let them explain again...
Paybacksays...The second one of the couple, when he asked if they'd seen his phone, I say he was totally valid. For a second I thought he was going to shock them for merely "finding" it.
nanrodsays...It's only entrapment if government agents induce someone to commit a crime they wouldn't otherwise be inclined to commit. In most jurisdictions courts have ruled that simply leaving something available, such as a bait car, is not entrapment.
