As stated in the video to Senator Franken, the courts decide if the Act is unconstitutional. A number of provisions of the Act have been declared unconstitutional by federal courts and struck down or revised.
I find this uninteresting because this seems to be simply a junior senator speaking out about an older ongoing issue over which he has virtually no power. He is not introducing anything new to the argument nor breaking anything new. This seems to be generating interest because the junior senator in question used to be a comedian.

Not sure why this is of interest...
