shatterdrosesays...First Amendment also protects parodies. If you're doing something in parody, then you are protected under free speech because it's a form of criticism. However, some companies use the copyright laws to shut them down because they say they're taking their ideas and profiting from them. It's a sad world that let's the media giants get away with it, considering these parodies have in the past stopped government corruption and helped cure a lot of social ills. But in essence, that's what 5 Second Videos is doing . . . taking someone else's idea and using it as a parody to make a point, which is unmistakably legal. YouTube is in the wrong and acting as a censor . . . and thus violating firth amendment rights. (But don't get that confused with violating their TOS which they can use as a right to censor and are thus doing.)
lucky760says...The problem is that Mr. Glasses is using actual movie footage, and it is copyright protected. Doing so is not parody even though what he does with the footage might be.
Though, it would be parody if he was merely imitating the footage.

AeroMechanicalsays...If they cut the whole thing down to five (or whatever) seconds, that may be fair use as well as parody. It would probably be difficult to argue that a 5,400 second movie compressed down to 10 seconds would be a replacement for the entire thing.
Of course, Youtube is a private site run by a private company, so I don't see why the first amendment would apply. They can do whatever they like on their site. This could well be wrong though.

bamdrewsays...On the copyright issues, he claims 'fair use' and argues that he's creating parody and/or satire of the copyright owner's work. This is still a poorly defined area of copyright law. I would actually disagree with this defense, as its difficult for me to see how a super-fast edit of a movie constitutes a parody or satire (unlike, say, a Weird Al song or something).
Here's a link of someone's analysis of the cases related to this... includes cases involving a Saturday Night Live advert campaign, Dr. Seuss's family, and 2 Live Crew... so thats pretty cool.

"Parody or satire, as we understand it, is when one artist, for comic effect or social commentary, closely imitates the style of another artist and in so doing creates a new art work that makes ridiculous the style and expression of the original. Under our cases parody and satire are valued forms of criticism, encouraged because this sort of criticism itself fosters the creativity protected by the copyright law."
lertadsays...Thanks for the link and additional info, bamdrew. Copyright laws in my country are so vague they might as well not exist, but I'm interested in learning more about what other countries are doing...
So, what about music "sampling"? I see a lot of this in hip-hop, some to good effect and some bad, but are there copyright laws covering it? Would this have to adhere to the same guidelines as artists covering old songs?
