Burden of Proof | Chilling One-Take about an Abusive Ex

newtboy says...

That was the point to me. That, absent video evidence or a rape kit, only a clear unambiguous confession meets the burden of proof, and she didn’t get it despite the dangerous position she put herself in to get a confession.
I doubt a DA would prosecute on this irl.
In a jury trial it might be enough for conviction, they’re notoriously difficult to predict, but not a non-jury trial.

I think maybe a temporary restraining order could be acquired in America with this evidence, but not permanent….just my opinion though.

All of these evidence, what are they worth legally? Is this at least sufficient to get a perma restraining order on him?

Abbot Claims Prosecuting Rape Will Eradicate Rape In Texas

newtboy says...

Turns out there is a backlog of well over 5200 rape kits in Texas that are awaiting testing, and over 230 police departments that didn't report how big their backlog is, so that number could easily be doubled or more.

Hard to believe he's a bit serious about stopping rapes in Texas considering his track record on getting them investigated or prosecuted, and that he hasn't requested any more funding for testing kits or investigating rapes to go along with this attack against rape victims.

McCain Claims Obama Rally Crowds Call Him Terrorist, Traitor

McCain does seem wrong on the details and degrees, as has been pointed out above, but he unfortunately seems right in the big picture (i.e. you can find liberals who'll say anything, like 'rape Palin.')

Who said that? Which liberal, on this board or elsewhere, said "Rape Palin?"

And did it have anything to do with the way she made rape victims in Wasilla pay for their own rape kits?

Palin Explains Why Raped Women Should Be Forced ToBear child

UsesProzac says...

"What a bitch."

Totally agree with that.

People like Palin scare the shit out of me. It's one thing to have a private belief or opinion, but forcing it on others is a horrifying thing to behold.

Making people pay for rape kits is absurd and humiliating.

I had my house broken into and the police came and dusted for prints and cordoned off rooms, and you know what? Never received a bill for that.

Something tells me that Palin has never been raped--I find it hard to believe that someone even willingly had sex with that talking head.

It's hard enough to report it when it happens. It's hard enough to submit yourself to a degrading experience of people up to their literal elbows in your business. Then getting charged for that? What a kick in the face.

People who've been abused by a parent or family member carry that shame with them forever.. And knowing that you'd have to pay for a rape kit if you came forward is just another reason to hold that pain inside and never address the person who raped you.

Ugh, and counseling a girl to carry her father's child is just wrong, genetically and in so many other ways.

Under Palin, Wasilla Made Women Pay for Rape Kits

MaxWilder says...

Woah, now, let's just stick to the rape kit discussion, right imstellar28?

Can we agree that a rape kit is only useful for the potential capture and prosecution of the offender? Can we not therefor agree that it should fall under the costs of the police department?

Even if we all donated money to a community police organization, would we want those donations to go toward necessary police costs, or bill someone every time they are victimized? To me, that seems to be defeating the purpose of donating money to the police organization in the first place.

How about we all just keep our money, then when we get robbed, raped, or shot, then we call up the police to deal with it and get an itemized bill afterward. Works for lawyers, right? They're not very expensive.

And, oh yeah, if you want good police work, that will cost extra.

Wonder if Ayn Rand was ever raped. Wm. F. Buckley intellectually raped and destroyed Ayn Rand's soulless Objectivism. Contrary to Rand, Buckley demonstrated that self-sacrifice was in fact -essential- to achieving rational enlightened self interest.

This is the great thing about the cultural bankruptcy of the 21st century. People can make wild statements without evidence and nobody bats an eyelash. Just ask Sarah Palin.

If everyone really wants to take from the rich and give to the poor--why beat around the bush? Just tax everyone 10% and divide the $1500 billion by 200 million people and write everyone a $7,500 check. People at at the $7,500 federal poverty level get a 100% increase in income, I get a tax cut, and I even though you are still forcing me to pay taxes, at least we can all have a free market.
