Hero Defends a Defenseless Blind Kid

Cool story, bro.

Except that in this video the only person in clear and immediate danger of dying is the guy who got sucker punched and took a header into the concrete. Blind guy, meanwhile, barely got rocked by the first punch and is in no immediate danger of dying. The facts, therefore, kind of negate your whole argument while strengthening mine.

Also, I provided ample links to show the relevant laws which come into play here and would force most DAs into prosecuting. Here's another one: take a look at California Penal Code 192(b). It doesn't matter that the kid was engaged in a lawful act (defending someone else). Someone was unlawfully killed and it's the DA's job to do something about it. Your counter-argument was essentially: "Nuh-uh, cuz I say so."

I've argued with you about stuff before and you've always been good at using evidence-based reasoning to support your position. I'll give you the benefit of the doubt that you were having an off-day with that reply (pressed for time in responding perhaps).

BTW, I think the fact that we disagree on this is yet another reason why a competent DA would let a jury decide rather than make the call him/herself. Their job is to determine whether there is enough evidence available that someone has broken the law to prosecute them. In this case we would have the video and multiple eye-witnesses showing a killing punch being thrown. Again, I don't see how any decent DA can NOT prosecute at that point. Their job is to represent the state and prosecute those who break the state's laws. It's the defense attorney's job to counter that the law was broken for good reason (self-defense), not the DA's job. It's the jury's job to determine if a killing in self-defense is reasonable under the circumstances, again not the DA's.

DA's do sometimes decide not to prosecute when there is overwhelming evidence that the killing was justified and a trial would be a waste of time and money, but this isn't one of those cases. For example, if the video showed the bully attacking the blind kid with a knife and then getting killed by a sucker punch from someone trying to stop him, it's unlikely any DA would take action.

At the end of the day, while I think if the kid had killed the bully he would have been charged with manslaughter, I also think it would be unlikely to actually go to trial. Especially if the kid throwing the killing punch is a first-time offender, the DA would likely offer a plea deal for a lesser charge.

Anyways, can we at least agree that it is great that no one was seriously injured in this incident?

My family owns and operates a farm, wheat and corn, in Kansas. We use Roundup herbicides sometimes.

Specifically, there is a GMO variant of field corn called "Roundup Ready" where the corn is genetically resistant to the herbicide. Plant a field of that corn, then after it emerges but well before harvesting (obviously) spray it with Roundup, diluted to an appropriate level. All of the pest plants in the field die. The corn looks a little wilted / harried for a few days after spraying, but bounces back and grows out just fine.

We use that specific kind (Roundup Ready) about 1 year out of every 4 or 5, only when pest plants are starting to become an issue. They'd love to sell it to farmers every year, but most only rotate it in when necessary, just like us, and use a small amount of normal seed (not GMO, just some of the normal corn we harvest) held in reserve from previous year(s) in the other years.

Before Roundup (and other major herbicides and pesticides), pest plants could be a major problem. From what my family says, corn can cross-pollinate or do some kind of hybridization with other crops like milo or sorghum or something, which results in a sterile cane-stalk plant like corn that produces no actual grain. Back 20+ years ago, that was a fairly major problem ... but it is very easily controlled nowadays with herbicides, and Roundup in particular.

Pure, concentrated Roundup is pretty nasty stuff. Then again, farmers still use or have used a lot of much nastier stuff during normal farm operations, like Malathion being sprinkled into grain bins to kill off insects and other small pests. I wouldn't want to chug down a glass full of any of that crap, BUT on the other hand I think we're way better as the human race off WITH all these things being used to control what can be or have been significantly damaging pests than how things would be WITHOUT them. Not to mention that all of these things are used in very very trace amounts compared to the actual amount of food produced itself, and usually a *really* long time before it becomes food. I think you'd be pretty hard pressed to detect any of them in the parts-per-multi-multi-billion scale by them time we eat them.


...That being said, the dude walked right in to this one. If his message was "this stuff is 100% safe and beneficial if used properly", I'd actually 100% agree with him. But when he's trying to oversell it by saying that it is perfectly safe to drink a glass of it ... of course somebody is going to call his bluff. Duh.

BUSH bailed out first the airlines, for nothing in return, then the banks, for nothing in return. Obama sadly continued that flawed policy, but did at least get partial ownership and concessions for our money, and got our money back. Bush simply gave it away with a smile and a nod.

Clinton absolutely did not have intelligence that Bin Laden was planning an imminent attack on American soil, Bush did. Clinton did not allow Bin Laden's relatives to leave the country after an attack, it's reported Bush did. Clinton had an opportunity to kill Bin Laden, with unknown amounts of collateral damage in a country we weren't allowed into (so an act of war), and decided to not start a war on flimsy 'intelligence'...a good plan now that we know how that goes.

Even the first years when federal income was severely depressed (thanks to the economy Bush left us with) he didn't spend like Bush, if you look at the REAL numbers, not the white washed, no war, no homeland security, no bailout numbers the republicans pretend are real.

Because the republicans decided that their plan was to obstruct ANY idea from Obama (clearly stated BEFORE he took office, and followed through), it didn't matter a whit how he led, they refused to follow. It's not about his leadership, it's about the republican leadership thinking that beating Obama is more important than governing. Refusing a 10-1 deal where for every $1 in raised taxes they get $10 in spending cuts....and they said NO! Get real for once, it's not Obama's leadership or lack thereof that's screwing us, it's partisan politics being more important than the nation...and we all know which side plays that game more often and harder. We had a squirrel behave a bit like this in our yard a few years ago. It kept trying and failing to climb a tree, couldn't get more than a foot off the ground without falling off backwards. We happened to know someone who volunteers at a local wildlife rescue center, so I put on some thick gloves and grabbed it in a nice soft towel, then put it in a cat carrier. A few days later we heard back that it had made a full recovery, and they suspected it was drunk. Turns out that when doing some home renovation my father in law had moved our compost bin slightly, but not all of the compost that it was covering. We assume the squirrel got into some old fruit that had fermented and got good and tore up.

I think you're missing the point, when you increase the sample size of a favorable bet, eventually the probability of you losing money in the series of bets becomes negligible.

Take the video's example of say risking a coin toss of $10 for a potential $15.

You only need to win 40% of the time to break even ($15 * 0.4 - $10 * 0.6 = 0).

To work out the probability of this for different sample sizes we just look at the cumulative binomial distribution:

For 10 samples, 40% success or more occurs 82.8% of the time.
For 100 samples, 40% success or more occurs 98.2% of the time.
For 1000 samples, 40% success or more approximates 100% of the time.
