EmptyFriendsays...these people are idiots. and that doesn't really look like a sidewalk, looks like part of the federal building, and i have to imagine defacing a federal building isn't allowed.
blankfist@EmptyFriend. Arguably the second guy WAS on the sidewalk. That aside, how is chalk "defacing a federal building"? And it's called "sidewalk chalk" for a reason.
Even beyond all of that, why do you think they let the child draw on the sidewalk and not arrest her?
EmptyFriendsays...just because the chalk isn't permanent, that doesn't mean it isn't defacement. it should just be okay for people to draw whatever they want on buildings as long as they use chalk?

i'm guessing she was encouraged to draw by the parents, hoping to draw a response. very irresponsible.
and i'm sure you don't actually wonder why they wouldn't arrest her. it's up to the officers to decide what they consider defacement. if i choose to, i can allow someone to graffiti my house.

public spaces still have rules, and breaking those rules can lead to arrests. here in san diego it is illegal to drink or smoke in all public parks and beaches, and you can be arrested for it (though you'd most likely only be ticketed).

Here's a pro tip. If they are idiots, then they let them make asses of themselves. Don't add to it by becoming the thing which they are protesting.

let them chalk side walk however warn them if they don't remove the chalk before they leave or before the end of the day they will be arrested for defacing public property.
if they are going to arest them on the spot it should be a case of arresting them for 2 or so hours then letting them go without charge , the piont of this would be to stop them from messing up the side walk but not waisting time effort or cusing a larger issue.
