Also, since the punitive damages are designed to impact the perp, it was tiny if you believe Trump about his net worth. 10% of his total net worth would have been a low amount, and she got under 2% of what he claims to be worth, under 1% of some claims, a nothingburger, stop whining. 😂

In your example, a criminal trial with different rules, the defense could be you didn’t see them, or they dove in front of your moving car, or you were having a medical issue….or one of a thousand mitigating factors. Trump presented no mitigating factors explaining the frauds, the differing values that changed 10000% in value on paper with his signature swearing to the truthfulness of the values he presented, values he knew were fantasy, so was found guilty.
(Side note- in your example the victim’s heirs would also get a civil trial where prima facie guilt would be established by the witnesses and your admission you hit them and you would need to have evidence supporting your affirmative defense that it was under duress to evade liability, just as they would need to prove malicious intent or recklessness to get punitive damages, IMO).

The banks indicated massive fraud, who told you they didn’t? Trump? The banks lost over $180 million in interest they should have received if the collateral values had been correct. Yes, they made some money, but lost out on $180 million plus.

Also, the Gold Standard defense against libel -- what you printed is actually true -- will not apply here, and it'd be comedy gold if the defendants actually tried this defense. At that point, the three fastest winds ever recorded on the planet would be Typhoon Li, Hurricane Katrina and the explosive laughter and legal pimp slap from the bench. It'd make Rudy's immense clusterfucks in court seem like goddamn Perry Mason cross-examining a 6-year-old.

So, on the billion-to-one chance you win a libel per quod suit, you get "damages", which can be surprisingly little as you have to prove every single dollar in very narrow legal ways. Libel per se, on the other hand, is the BIG PRIZES. Your ass is at least catching dollar damages that would make Jerome Powell say "Y'all niggas need to tone them digits down, yo!". Those damages are ANYTHING THE COURT DECIDES. Again, LPS means the plaintiff doesn't have to prove a single dime of loss to claim damages of damned near any amount. Given that Dominion is asking for a cool bil-point-something, I wouldn't be hugely surprised if another zero wasn't slapped on the end of that figure.

That's just the "actual" damages. If you egregiously fucked up, like claiming a company overthrew a US election and was in league with a dead dictator, you get to spin the wheel of punitive damages. Punitive damages are how the court hands out spankings, only they're not spankings, they're that scene from 12 Years A Slave, only with less tickles and kittens. Given the shitstorm that followed the lies about Dominion, those damages could make the initial billion-dollar claim look quaint.

(By the way, you can't discharge the settlement in bankruptcy, given that libel per se is considered 'malicious', meaning the laughter from the judge presiding over your initial case will be roughly 1/10,000th the laughter coming from the bankruptcy judge.)

Guns. I am OK with some gun control. But it is clear that no matter what, Democrats will make every attempt they can if they sweep the election to re-do the assault weapon ban, apply punitive taxes to ammo (and possibly guns), and remove the right to private sale.

Bedo was the only one to fully admit it, but Biden has been harsh on guns as well going by comments alone. I don't want Trump back, but I want the Senate to stay Republican to counter gun measures.

I know it's unpopular, but I am one of those people that will never give up my rifles, my pistols, my shotguns, my large capacity clips, and my right to buy as much ammo as I wish without paying another government tax. I also feel I should be able to give or sell my firearms to someone I trust, be it a family member or close friend.

I believe the only real solution is to recognize that the role of a police officer is one that is inherently unstable. As history shows, it is impossible to expect one small group of people to deal with all the violence, anger, punitive actions, and force for all of society.

But without this group of mentally and morally unstable people, then each person in the populace at large would need to individually learn how to deal with violent offenders, restrain someone, know when to use lethal force, adjudicate their punishment, carry out their punishment, handle traffic accidents, dead bodies, emergencies, and so much more. The culture at large already expects every person to delegate these tasks, and if an individual does not immediately call the cops there may actually be punitive action taken against that individual.

I have no solution to this societal problem. But then again, I don't feel obligated to solve the problem for society. In fact, the eventual destruction of the society (that so delegates) may be the eventual "solution" that inevitably comes without collective individual change. I'm content having a solution fit for myself, my family, and for those who other souls who come to me personally for a solution (to varying degrees).

The belt isn't the answer, it is a tool. The same way physical punishments like Push-Ups are for Military discipline. The same way solitary confinement or hard labor is used as a tool to provide discipline in prison.

I do not subscribe to the notion that non-punitive punishment is effective. Offering Johnny a new game if he doesn't torment his sister is teaching him that being bad is rewarded.

In the case of this incident, the belt was used as a tool to indicate that he had broken the rules and it was reinforced later by grounding.

Conversely, she could have taken the other available option and simply called the police to report her car stolen, which it was. His being her son does not excuse him from a crime of taking a vehicle that does not belong to you. That method would not be considered child abuse according to the guidelines you propose, however it would lead to juvenile charges, exposure to the legal system, and a simmering hatred of his mother that I suggest a simple embarrassing spanking/grounding would not.

Can you take it too far with physical punishment? Absolutely, and then it is most definitely abuse. Beating a child with an improvised switch until the child bleeds is abuse. Spanking them with a belt a few times in public, which adds a humiliation factor to the punishment, is not.
