Officer Facing $20 Million Lawsuit for Excessive Force

CBS: On April 30, Tappahannock police Sgt. Everett Woolums stopped Churchill's sons while they were riding their bicycles. 19-year-old Brian and his 21-year-old brother Brandon were heading to the trailer park where they live when they were stopped for having improper lights on their bikes.

"They were like 'we're on our way home' and he was like 'get off the d-a-m bikes,'" Churchill said her sons told her.

Tappahannock police Chief Jim Barrett told CBS 6 that the boys ran from Woolums and that the pursuit briefly became physical. Barrett said it also became clear to Sgt. Woolums that the boys had mental disabilities.

"He had him by his arm and kept wrenching his arm and he broke his arm, he broke his arm in two places," Churchill said about her son, Brandon.

The boys got away, made it home and their mom called for an ambulance. The chief says Sgt. Woolums learned of that call and, without a warrant, went into the boys' home and arrested both of them for obstructing justice.

Dunno about the guy he shot and killed, I mean if the dude was reaching for his gun...yeah I could see that being a case where the cop shoots and kills a guy.

But the one where he chased a couple guys on bikes over improper lights on their bikes and then broke the dude's arm in 2 places and it being bad enough to require surgery?....Especially when there's a good chance the people on the bike may not be 18. Unless they know the guys are trouble makers or drug dealers from previous run ins...It'd be a hard sell to convince me the cop didn't have a chip on his shoulder.

He needs to beat on some white/asian guys, because when you got a lot of black people accusing you of violence.....it starts to look racially motivated.

A human being died for running away. A HUMAN BEING DIED FOR RUNNING AWAY!


Wrong! A human being died for being stupid! Happens every damn day. He resisted arrest, fled the scene, then FOUGHT with an armed police officer!

I'm not saying he deserved to die. But when you're an idiot, and you fuck with somebody who's got a gun, then don't be surprised if that's the end for you.

You obey the officer. If you are wrongfully arrested, you file a complaint and sue later. Or you can risk a painful death. Choice is yours.

I got no sympathy for him.

The officer in this case realised that the kids had 'mental disabilities', still no sympathy? I agree that if you're dealing with an officer, being respectful is the most sensible way of not turning the situation into a clustercuss, but I hope officers can use their discretion, especially when dealing with vulnerable individuals. And most of them do actually. I've had lots of dealings with the police over the years, and they've all been pretty cool.

Look, there's no doubt he deserves to be thoroughly investigated for the incidents decribed. Maybe he even deserves to be thrown off the force or into jail. I don't know, I wasn't there.

All I'm saying is, if you disobey an officer and resist arrest, you are asking to get seriously hurt or even killed. In the case of the two kids, their parents should have taught them to respect and obey officers. Sure it sucks when the officer is an asshole, but you are just making it worse for yourself if you try to run.

That being said, everybody should know their rights. "I have been advised not to speak to law enforcement without the presence of my attorney. I do not submit to any searches. Am I free to go, officer?" Stay polite, don't touch them, don't get upset. Anything they do wrong, you can sue them for afterwards.
