The person who threw the shoe was exercising his freedom. He didn't hurt anyone and is unlikely to have hurt him much had that actually hit the target.
They have arrested the man just for being rude to the guest and the host basically.

I'm sorry, but it is a bullshit argument.

Was a show-throw the best way to go about it? Maybe not. But this argument of "Bush isn't as bad as Sadam" is up there with the line from the New York Times review of Starwars Episode III "It's better in as much as natural death is better than say crucifixion."
