My link is dead, but it still hasn't been discarded as its only been one day. I was just about to replace it and found this. What do the rules say? Can we discard this if the exsisting video is dead but hasn't been replaced?

This video should not have been posted. It is a duplicate because when posted, the same video was still on the site. Yes, it was dead, but it was not discarded.
