This. He's not going to waste US taxpayers' money issuing a ticket which then needs to be processed and ignored and eventually cancelled, so he tries to scare the tourists into slowing down. That's about all he can do unless they're doing something worthy of arrest.

Not the best look when this is the only one of his thousands of traffic stops you see, but give the guy a break.

Given how rarely someone has a camera on them to film these things, you could be forgiven for thinking every single US cop was like this. How often does a traffic stop go like this ? - pretty awful police work imho.

How is this for a double-standard: if a cop sees someone committing a crime, they are required by law to stop it. Whereas you, a normal citizen, is not required by law to do anything. Is that unfair? Or is that because stopping criminals is part of a cop's job description?
Cops are allowed to do things that normal citizens are not. They can put up barricades. They can direct traffic. They can use "police only" radio channels.
It seems to me like this is equivalent to walking into a hospital and saying, "I'd like to perform some brain surgery, and if you don't let me, you're holding me and the actual brain surgeon up to different standards!" But they're not holding you up to different standards at all. Almost anyone can go to school to become a brain surgeon. But the school part is a requirement to actually practicing the work.
In the same way, almost anyone can go to a police academy or other training school and become a cop. So it's not a double-standard, it's two separate roles that individuals play in a society. Roles that are established by that same society. It's not that complicated.
Again, if the cop was using an illegal space to park in while he went and got a tic-tac or something, I could see the argument. But this isn't even an argument. It's crazy talk.


Cops are allowed to do break the law only in the case of an emergency.

A citizen is not afforded the lawful power to stop someone from moving freely on the street, or in the commission of a misdemeanor, or felony.

When was the last time you saw Special Weapons and Tactics carrying around fully automatic weapons on a beat, or a QRT for that matter? No, they cannot just walk around with their fully automatic weapons while patrolling. That argument is bogus. Force proportion. A peace officer does not need an M-4 to perform a traffic stop.

Cops are allowed the erect barricades only in case of emergency. Traffic redirection is case of emergency or special occasion, funerals and the like. In some cases officers have the legal authority to setup checkpoints for license and registration checks. That's been argued that they cannot do that because it hinders freedom of movement, and the police didn't have a legal reason to stop. Other than to check if someone committed an offense.

You will find that police only radio channels are often encrypted, because the public can listen to them, and hijack them. Which is illegal and those laws are enforced by the FCC.

Your argument above has many sections I would say are crazy talk. The video producer's argument is simply stating if a officer who is at rest and is illegally parked he or she is violating the same law he or she is sworn to uphold. There is a reason that area is illegal to park in; fire hydrants, bus-stops, bicycle path, or whatever reason the municipality decided citizens can't park there. What is the officer doing? The exact same thing a citizen would be doing, except he has a different hat on.

This has been argued over and over. The only time an officer can lawfully break the law is in case of emergency. It's the same case when an officer is speeding without his or her lights and sirens active. The only time anything ever gets done to stop unlawful activity is when someone raises the red flags, otherwise it will continue.

Whether the producer's a douche or not is beside the base argument of this video.

I'm 100% sure he fucked up and accidentally shot the guy. It was a mistake. He wasn't following procedure, and he fucked up.
That said, I'm glad they convicted him. He should have plead guilty and begged for mercy (after voluntarily resigning from the force.) Trying to paint this as a justified shooting is just as heinous as the original mistake.

It's not as if he dropped his gun on the ground and it went off. Besides, the defense didn't claim it was an accident. They claimed it was intentional, but that the cop mistakenly believed he was pulling a gun.
I'm just grateful they had the dash cam. Perhaps cops should be fitted with cameras at all times to keep them from lying about shit and covering for each other.

Traffic cops are surely used to that... motorists move their hands around all the time during traffic stops while the cop is walking up. They get their documents from the glovebox, they look in their pockets for their wallet, etc.

It's in your own best interest to keep your hands on the steering wheel to make sure the cop doesn't view you as a potential threat.

I won't argue that it's rife with potential for abuse. But all a cop needs to search your vehicle during a traffic stop is "probable cause" - so let me ask you this: When is the last time that you, a friend, family member or co-worker got pulled over and had your/their car searched?

Rife with potential for abuse does not mean rife with abuse.

And case in point: I just got back from a ride on my motorcycle that I had parked in some extra space next to my car. I was putting the cover on it when a painter (they're here to paint the covered parking) came up to me and asked in what was only barely passable broken English if I could move my car further away from the cover they were about to paint. It was something like "you move...car? We paint...spray....over there....we cover bike easy.... car big." I'll leave out the pronunciation effects like "jew move" so as not to be an ass, but let's say I had to think about what he was saying to actually understand it.

my point is this: This guy could very well be an illegal, and probably is. It's no secret that they're hired for unskilled labor such as this. While yes, he is working, if he is indeed illegally here, it means he's not paying taxes. That means if his residence catches on fire, he receives free services from the fire and police departments. I'm not saying that you or I would get a bill, but they are funded by our tax dollars. If he catches a stray bullet from a near-by gun fight, he goes to the hospital on our tax dollar. To be a little more realistic, bear this in mind: If a Mexican crosses our border illegally only to have birth three feet across it, that child is now an American citizen, and will receive post-natal health care in our hospitals on our dollar. This happens ALL the time.

Man, this is tough. I see everyone's point of view on this. "They were both stupid" seems to sum it up.

Having said that, I would like everyone who has jumped all over this officer for reacting so strongly to imagine that their brother or father or sister or mother is a police officer. The point that someone under arrest gets back into a vehicle, with the possibility of getting access to a concealed weapon, is probably why he got so hopped up.

What are the statistics on cops getting killed/attacked during routine traffic stops -- even if there are kids in the car? I know that domestic violence situations are very dangerous for police officers. I have the impression that traffic stops are, too.

If that was your loved one in a potentially lethal situation, I think you might be more forgiving of the over-the-top behavior.

Stay in your car. Keep your hands on the 10 and 2 positions on the steering wheel. Follow instructions. Remember that the police officer might be as scared of you as you are of him/her.

De-escalate, don't escalate.

[I just went and read the MSNC article. The 15-year-old son knew she was being stupid -- he yelled at her to get back in the car. At least one person in the family has some smarts.]
