That's a gem in this segment of the show.

Of all the things I don't agree with Maher (recently of the Mask Mandate, sooooooooo misinformed and/or self-centered, he's part of the prolonged problem), I must say, his fixation on not cancelling anyone and while urging people not being snowflakes are right stands for me. As much as a "political opposite" some people are to me, I'm actually far more interested in the reasons behind why they take those stands, whether they care to explain themselves or not (because, come on, we KNOW American culture breeds goats and they can only parrot what their political/religious/news/social media overlords tell them without understanding the ulterior motives behind their words & actions). I've long given up expecting one half of the population to be able to articulate thoughts.

His shows are still able (willing?) to invite "both sides" to the table. For that, his shows are worth watching.

The supreme court is in a position to interpret the law because that's how our system works.
The Judicial's role is to INTERPRET the law that congress writes.
Due process is followed. You mean if strict, literal interpretation with no thought were the rule. It's not though.
Yes, the judicial interprets the legislature....so their interpretation may differ from the specific words in a law.
No, it's a matter of what the courts say is enforceable. Our system does not change laws because some, even most people disagree with the law. Just look at gun laws if you think differently. The people are willing to enforce more background checks and willing to bar anyone on the watch list, the legislature isn't. Enough of everyone is 'on board with twisting the rules', but they can't because the courts say they can't.

Um...yeah...you just keep thinking that "well regulated" has nothing to do with being regulated. I disagree.

I don't understand your point about eminent domain....Full Definition of eminent. 1 : standing out so as to be readily perceived or noted : conspicuous. 2 : jutting out : projecting. 3 : exhibiting eminence especially in standing above others in some quality or position : prominent.

Sounds the same to me.

Courts have a mandate to judge compliance with the law - not to redefine the law (that's the legislature's role).

If due process was followed, courts would find cases like 'yelling fire' as protected, and refer the law to the legislature to exempt-from-1st-amentment-protection any inappropriate behaviors via new written constitutional law.

As it stands, there are many judicial opinions that are enforcible via the legal system, that are never written down as law by the legislature.

Again, it's a matter of what people are willing to enforce. The courts are just people. The law is only as important to them as they will it to be. If everyone is on board with twisting the rules, then that's the norm.

(aside : Yelling fire is a stupid example. If you did it, everyone would look around, and then look at you, and would be like "wtf are you talking about?")



Words are written to convey meanings. They don't exist for their own sake. The 1791 meaning of "well regulated" is similar to today's meaning "well adjusted". It would be best summarized as "orderly" or "properly functioning". It has nothing to do with government regulation.

Similarly, "eminent domain" means "obvious domain" (obvious because republic, and every citizen (i.e. statesman) owns the country collectively, and you never actually owned your land, you only had a title to be the sole user). (Sounds weird by todays' standards, but back then the only private ownership was that of the crown, it owned everything, and regular folk were landless. Having all the people own the land, instead of some king, sounded quite progressive.)

Sounds a bit different when translated from 1700's english to 2000's english.

That assault on the subway -- that happened to me at 11 am on a Sunday in NYC. Beautiful sunny day. Outside. I stopped to watch a street vendor with a crowd, and someone was jostling me from behind, I thought to see better.

I realized he was jostling me rhythmically and panting.

I had just finished a self defense class, so I thought I was prepared to deal with it. I turned.... and looked down. This tiny guy was standing behind me, with a tent in his pants. I was 6 inches taller than him, and outweighed him by probably 50 pounds. He just looked up at me and... shrugged. Shrugged and smiled.

I had the physical skills to decimate him, but we were taught in class to use the skills to protect ourselves, not to attack.

I wasn't in danger. So I turned on my heel and walked away. Joined my friend, laughing. I'm a tourist in NYC for six hours, and I get sexually "assaulted." How funny!

It wasn't funny 15 minutes later. I started crying, just like this woman. I spent the day with my back against the wall where ever I went. I couldn't stand to have someone behind me. I kept feeling him on my ass. All day long.

I finally asked my friend to replace the "muscle memory." So she put her hand on my butt where he had assaulted me, and said soothing words.

That worked.

For six months. Until I was standing in line for a movie back home, and the man behind me had a cold. I could hear him breathing and I internally flipped out. I kept moving so he wouldn;t be behind me, but he wanted to stay in line, and kept getting behind me.

I went into the theater, took a seat, and sobbed.

Over something that didn't physically threaten me.

I had guilt over how I handled it. I had just taken that self defense course, and I had heard a story that amused the hell out of me.

A woman was on a bus, rush hour, pressed into the crowd, when a guy started groping her.

Know what she did?

She said LOUDLY so EVERYONE COULD HEAR -- I want you all to know that THIS MAN, THIS MAN RIGHT HERE, is touching me. I did not GIVE HIM PERMISSION TO TOUCH ME.

He slunk away. He left her alone.

I wish that this video offered solutions.

It was frustrating to know that the blonde woman was in a car full of people, and she didn't have a voice. She wasn't taught to speak up and make a scene.

And it is months later, and because she didn't speak, she still carries that.

And it is months later, and she didn't offer a solution based on her experience. She is still caught.

I'll tell you one thing -- that happens to me again?

I'M SPEAKING UP. Calmly. Loudly. Assertively. With conviction.

THIS MAN. THIS MAN RIGHT HERE.

If all women did that, this crap would stop.

They count on us staying silent.

Tell this to the women you love. Tell them to speak up if they feel safe -- and a crowded bus, a crowded subway car? You are surrounded by people. Nothing is going to happen to you.

They operate in the dark. They operate in silence. They count on your embarrassment.

Turn it on them, embarrass the bloody hell out of them and this crap will end.

I can't vote on what I don't know.
I don't believe in a God Theory, and basic evolution, from single cell to humans as we know them, can sometimes seem quite a jump.

The idea that earth was somehow seeded is interesting, whether from asteroid or from terrestrial colonization, this concept has too many variables to predict.

I believe we may never know and I'm okay with that. I'm going to have to be since they'll never figure it out in my lifetime.

If I "have to" choose, I'd say we are a colony. I'm not going into a 12-page write-up here but this concept seems to make the most sense to me. Of course I have no proof so, I'm not going to strap on a sandwich board and stand on the street corners any time soon

At some point, back at the beginning of time, the term evolution is the only term that can describe origin but I'm sure it looks completely different that what we can picture. What ancient man refers to as gods, could have held it's origins in transplanting, colonization, teraforming and so on, but where did "they" come from? They evolved from something else.

So the term, "Evolution," still stands for me - it just might look different in reality.

Introducing Galaxy Nexus and Android Ice Cream Sandwich

Consensus in the Geek community is yes for the Nexus S, if not for the more locked-down models. Though any Ice Cream Sandwich update will obviously absent some features such as the aforementioned soft buttons and the barometer related content. That's for me really the big reason that I paid for an un-subsidized and factory unlocked Nexus unit, I don't want some carrier or handset maker standing between me and the software I want to use simply because it interferes with their revenue model. The Nexus models represent what Google intends the Android experience.

I wonder if they'll even be back-porting Ice Cream Sandwich for older devices. I'd imagine not since they'd need to customize it for the unsupportable features (e.g., software buttons need to be removed if physical buttons exist).
