On the copyright issues, he claims 'fair use' and argues that he's creating parody and/or satire of the copyright owner's work. This is still a poorly defined area of copyright law. I would actually disagree with this defense, as its difficult for me to see how a super-fast edit of a movie constitutes a parody or satire (unlike, say, a Weird Al song or something).

Here's a link of someone's analysis of the cases related to this... includes cases involving a Saturday Night Live advert campaign, Dr. Seuss's family, and 2 Live Crew... so thats pretty cool.

First Amendment also protects parodies. If you're doing something in parody, then you are protected under free speech because it's a form of criticism. However, some companies use the copyright laws to shut them down because they say they're taking their ideas and profiting from them. It's a sad world that let's the media giants get away with it, considering these parodies have in the past stopped government corruption and helped cure a lot of social ills. But in essence, that's what 5 Second Videos is doing . . . taking someone else's idea and using it as a parody to make a point, which is unmistakably legal. YouTube is in the wrong and acting as a censor . . . and thus violating firth amendment rights. (But don't get that confused with violating their TOS which they can use as a right to censor and are thus doing.)

Copyright law is becoming the bane of creativity and collaboration and derivative works, not the protector that it was originally intended to be. There's very little difference between sending your friend a good track that you heard and inviting him over to listen to it in person, except that the convenient way is illegal.

Fuck Youtube and all the DCMA ass-bandits who had a hand in taking this video down. An intelligent, witty, well-produced and -edited video that encourages its viewers to take a moment and use their brains for once, and you genital-monglers trash it for the sake of some fucking petty copyright law, because maybe then you can clink a few coppers more into your pools of cash? What has our society come to? For fucking shame.

The digital copywrite laws are so disjointed that it will take a play by play for each and every video to determine if it breaks the law. The law prohibits making money from reproducing the work or from reproducing the work in its entirety. Showing a clip or a portion of a show is technically not in violation of copyright laws. Technically.

The argument is this: If you are at a party in my house and I play you a video that you did not purchase, is Sony - who made the DVD player that I am showing you the video on - in violation of copyright laws? Many people are viewing it, but they did not purchase the video. I am sharing it with everyone at the party through a piece of equipment.

This is the argument for video share sites. Or for anyone who streams a video onto their web site. In the past, clips or portions were not considered in violation, but the big studios are trying to change that.

I rather think YouTube will try and keep good relations with anyone (ie Big Studios) who complains of copyright violations.
