Because in the US, at least for the time being, I believe the police must detain or arrest you in order to keep you. If there's no proof of a crime being committed, they must let you go.

I think if they suspected this man was wasted, they'd make an arrest based on that assumption, because there'd be probable cause to support that. And certainly a strong smell of alcohol in the car. But this man was visibly sober, so they let him go.

What is the point of setting up a checkpoint if people are allowed to just drive through it? In NZ, and most other countries, it is illegal to refuse a breath test if you are stopped at a checkpoint.

Based on this video, someone could be wasted drunk, and cruise through a checkpoint by just refusing to co-operate. That's just fucking stupid.

News media has no free-will to program anything-all are mouthpieces for a failing machine. Government abuse = warehousing my emails and phone calls, installing cameras driven by facial recognition software, requiring a number generated at birth for me in order to facilitate livelihood then stealing a percentage to continually improve their global scam..etc, etc, etc.

I agree that's what should happen, but that's not even what happens to people in California, at least, who are civilians who kill someone with their driving, whether drunk or sober. It most certainly isn't going to happen to a trooper.

Staged or not, the subtitles speak the sobering truth of the planet at-large. The difference between a kid with a head full of sports statistics and one abreast of regional religious extremes and government abuse is the difference between growing-up watching cartoons and playing XBOX and being raised amidst the sounds of mortars and helping your mother raise your siblings while dad is out chewing Khat and talking Muslim smack with his buddies.

Srsly, what you hate about Islam and Muslims-at-large lies in the root developmental-disability: Something so hard-wired into a culture it would take several generations to correct or, as I have mentioned before, a collective world-wide experience that flips the paradigm on it's head.

and here I just was commenting and defending us officers on the other "police state" video (where law enforcement handled it properly) and then here comes a video like this.

Only thing to say is the cop made a mistake and obviously become completely flustered by it as he probably knew he was being filmed. This does not give him the right to be an asshole. I have to ask what is the age of the male that is taking the PAS (preliminary alcohol screening) test? If he is under 21 there is a no tolerance policy towards underage drivers with alcohol in there system. He could of blew .01 and still be arrested. Anyone under the age of 21 should not be consuming alcohol (I know I know, we all did it) but if you do, DON’T DRIVE.

That being said, just a few notes so everyone knows (may only apply to California). In California (and I believe everywhere) you can be under the legal limit of .08 BAC and still be arrested for a DUI. There are two subsections of the Vehicle code for a dui, VC 23152(a) and VC 23152(b) which are usually both charged. The B section is only for if you are over .08 BAC. The (A) section can be used if you are driving erratically or unsafely even if under the legal limit. That section is also used for when driving under the influence of a drug (pot, prescription meds, etc..). 9 Times out of 10 in court the charge of VC 23152(A) will get dropped to a wet and reckless which is treated like a DUI but with fewer consequences.

Now, please do not take the advice of these other people and refuse all testing (in California). In California, there is a law called Implied Consent, please read here:

but to sum it up, you have to give breath, blood, or urine when arrested with probable cause for a DUI. This may not sound fair but it was put in place so people could not refuse all testing then go to court and argue there was no proof of their intoxication. There are penalties if you do not give samples so please read that link. This law can help both ways, as an example if you really are not under the influence of alcohol or at least under the legal limit, then the blood test (most accurate) will show this. This will either liberate you in court showing you were not intoxicated as the officer said or at least get your DUI dropped to a wet and reckless if you were under the influence but at a legal level. Of course, if you were really under the influence or got into a DUI crash nothing is really going to help you but a good lawyer.

Just as an example, a woman was stopped for making an illegal U-Turn. Before this officers admitted she had been driving ok. Once officers pulled her over to issue a citation they immediate smelled alcohol coming from the car and her person. The female agreed to a breath test and blew a .38 BAC! For most people including guys, you would be unconscious if you had that much alcohol in your system. The woman was charged for a DUI but more importantly got alcohol counseling because the court ordered it. This is just an example of times where people who drink on a regular basis (alcoholics) may not show signs of alcohol impairment. They are such sever alcoholics who can function to an extent while intoxicated. That DUI arrest probably saved the women’s life.

All I am trying to say is I know it may seem unfair or prying to have an implied consent law here in California. All it is meant to do is to encourage people when they go out to drink to please GET A CAB or SOBER driver to take you home. Sober does not mean you “feel” sober, sober means no alcohol or you have followed the guidelines issued by California DMV on how many drinks / how many hours it takes to be sober enough to drive.

Lastly, I will say there are ways of helping yourself during a DUI situation so educate yourself and do some research (not that rusty penny or mustard or barely blowing your breath crap) if you are really worried that one day you’re going to be pulled over after consuming alcohol.

I would rather the police forced entry than let someone remain in a state of harm. I'm sorry, but I've had police come to my home on a 911 call and they were forced to ensure that no one was in danger. In my case my phone had a 911 button on it that got hit when I was cleaning my room, but they don't know that. The guys were polite, walked the house to make sure that everyone was safe, thanked me for my cooperation and left. These are cases that are only as hard as you want to make them. This situation is as stupid as people who are sober refusing to cooperate at sobriety checkpoints.

Based on the that sadly broad ruling, if a 911 call is made claiming even possible domestic violence, police can force entry into a residence to see if everyone is ok. I don't like it or agree with it, but they will walk on any charges from the entry.

I do think they could call the immediate use of a taser into question, however.

Back in shop class, when I was about, oh, 12, we were doing some metalworks that involved heating things up with a propane torch. Now some kids noticed a thin metal rod will heat up to a glow quite quickly and looks kinda neat if you wave it around fast. The teacher being at his desk at the time (he was a bit of a dick, to be honest), we spent a good while waving glowing hot metal bits around the propane tank.

The valve on the tank must have been faulty, because suddenly the top of the tank was on flames. You wouldn't believe how fast a room full of 12-year-olds evacuates itself when an explosion seems imminent. Some kids went out the door, others went out the window (we were in a basement with a window right at ground level) and some simply hid behind a sturdy desk far away from the flaming tank.

Our teacher wasn't quite disinterested enough not to notice the ruckus and went in to extinguish the fire. First he tried to stamp the flames out with his shoe, managing mainly to re-arrange the patterning of his soles, and then got a fire-extinguishing glove which did the job.

As I said, this teacher was something of an asshole, seeming to get his kicks from berating and belittling the kids he was teaching, but this time what followed was a very sober and concise lesson on fire safety. Everyone was left with the feeling we'd all gotten very lucky, and there was this worldess concensus that it'd really be best for all concerned if no-one said a word about what had happened, ever.
