Ummm... close, but no. The Posse Comitatus Act is a law signed in the late 1800's and is not included in the Constitution. There are also no specific guidlines governing the use of the military in disaster scenarios in the Constitution. Here is the current wording:

"Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both."

Posse Comitatus means the power (or force) of the country. This refers to raising a militia. It was originally written to stop the government from grabbing able bodied citizens and forcing them into service, or a posse, for the purpose riot control, keeping the peace, arresting criminals, etc. This was part of English common law at the time. Prior to 1878 when the law was originally signed, it was a regular occurance to see the US Army enforcing law. The law was later amended to prohibit the US Army and Air Force from being used to execute law, but it's original purpose was to prevent local governments from forming a posse, or taking control of the military for purposes of law enforcement. Although it can be overridden in situations expressly authorized by the Constitution, or when authorized by Congress. This has happened many times before in the past in the case of disaster relief. For example, in the 1930's the Army Corp of Engineers performed disaster relief operations and aided communities in preventing and repairing flood damage.

I'm still trying to find out more information on exactly how this whole dwell-time mission thing began and who is authorizing what. As of now, the article only references training in case they are called up for support. If it is approved by Congress, then they are legally allowed to deploy. Since this has happened in the past without incident, it is reasonable to assume it could happen again. Going on what I know from talking to the unit, they were ready to deploy for Ike, but were never called. I can only assume this means that since Congress didn't say they should go, they didn't go. It would be illegal if they just started deploying without approval since the changes were repealed from the Insurrection Act in January of 2008. I'm not exactly too happy with the idea myself, but I'm not seeing this as the doomsday scenario other people seem to be visualizing. It looks more like a response to continued reports and complaints about Federal shortcomings in aid during recent natural disasters.

The point isn't that there may have been Iraqi soldiers there. The point is that they weren't there yet the US army went around acting like they were anyway, even claiming that they were under fire in early reports.

The point is that the invasion force was tipped off, then decided to storm the hospital and turn the entire thing into a propaganda loop.

I didn't post this to bash the military as much as I posted it to remind people that the Bush administration, and its toadies in the Pentagon, will stoop to any low to create an image in the public mind of a reality that does not exist.

I would suspect a much more subtle approach Sea side incursion, while the main forces are distracted by say that group of choppers running a feint attack.

Its dangerous, because once they hit the ground... its going to get a lot worse. I would have just blown the to pieces.

I know it's just a game, but past the neatness of the video, I can't get over the circumstances being depicted.. I imagine the US army would KNOW they would have anti-air fortifications on Gov. Island to be captured and used against them and might hesitate to send waves of vulnerable helicopters to it without first trying to take them out.

What has been done to Iraq and its civilians is a clear and defined story. What is not defined is what this meaningless war has done to the best volunteer army in the world, it has shatter the lives of thousands of people who gave their hearts, sweat and blood to make something out of the cluster fuck they were assigned, if not killed, they are horribly injured, if not injured they have PTSD and have to deal with the VA whose funding is not sufficent and the general bureaucracy of the military.

They have done incredible things, from pacification of Fallujah, Sadr Army, Fedayukin, all while riding around from the threat of unseen enemy fighting on tactics designed for confrontation of a uniformed army.

Now they are there trying to make something out of the sacrifice of lives already lost. I feel sorry for what the US Army and Marine Corp and all other uniformed forces had to bear because their leadership and command structure was too weak to argue against a ridiculous assignment by a joke of a president and secretary of defence and national security.

He's living comfortable in the UAE.

All religious practice should probably be discouraged in the military, the last thing we need is the US army fighting holy wars.

if it were true about Iranian weapons, then where is the evidence. I'm not talking about anecdotal accounts from individual troops, I want to see photographs and physical evidence that reporters can actually see and touch. Up til now, there has been nothing like that. In fact, when the US Army tried to show off some "Iranian" weapons to reporters, they had to cancel it before it started because they were 'mistaken'.
