e.g. Bond has escaped from the laser table, fought his way through the shark tank, draws the gun hidden in his sock, and shoots the evil mastermind -- but it's empty! Cue Dr. Evil's slow echoing clap. "Very impressive Mr. Bond. Did you honestly think I didn't know about your little toy? I disarmed it while you were unconscious!"

I hope that GooTube fights it all the way, though I feel certain that they will angle for a settlement with restored access rights to Viacom's shit (Joost be damned).

The issue is secondary markets. Viacom would have a clear winner if they were suing only for infringement of stuff like the full episodes of 24 on YouTube before primary distribution. However, Viacom's rights to control of secondary and tertiary distribution outlets and, more importantly, secondary distribution of excerpts are much closer legal issues. It would be interesting to see GooTube pursue 'fair use' arguments in this case (not too sure that it is a fair use under the current laws).

Distribution is $$ and control. And right now, GooTube is positioned best for profiting from secondary and tertiary distribution. I can see why Viacom is bringing the Dr. Evil suit, but I don't agree with a single word of their argument.
