Federal laws have upheld special councils exactly like Smith, appointed the same way, and that has been upheld in dozens of cases including some at the Supreme Court. No ruling or law changed that, a note from Thomas is what you are referencing, not a decision or ruling….that doesn’t change the law or precedent.
This is one partial compromised unqualified judges ruling, and like her others will be reversed as soon as the 11th convenes, possibly without the need for a hearing it’s so obviously completely unsupportable by any case law…probably why she didn’t cite any.
The case will continue with Smith, and is continuing under appeal.

If special councils are illegal, you agree Biden’s case should be tossed, right? His special council was appointed the same way. I disagree, but I hope he abuses the misinterpretation just to see you lose it.

In the unlikely case that it reaches the completely compromised and sold to the highest bidder Supreme Court and they rule against their own repeatedly codified precedent AGAIN, it can be retried with a normal prosecutor using all the evidence gathered…unless the felon is elected and pardons himself.

Once again, his defense is “there’s a technicality in the law that should let me free” not”I didn’t do the crimes” not even “that’s not a crime” anymore…he’s on to the final last ditch escape attempt…”the law doesn’t apply to me, and trying to make it apply is illegal!”.
