Creationist "Discovery" Institute Busted

kagenin says...

"Despite the "penalties" for an inappropriate use of takedown notice, I don't think there has been a single case ever where this has been applied."

See the public YouTube case of VenomFangX vs. Thunderf00t.

That's just how one false DMCA claim was handled (oddly enough, very similar situation - creationist wanted to stifle free thinker's free speech). There are many more where the DMCA's misuse has seen consequences, and some big names have had to say they were wrong. The EFF would probably be a good place to look, since they're usually involved wherever the DMCA is being invoked, and often, they help with legal expenses of those falsely accused of DMCA infraction (although both Thunderf00t and DonExodus2 both found pro bono help - it seems when it comes to the DMCA and getting a sure-fire case win, you can expect lawyers to come out of the woodwork to your aid).

If you file a DMCA notice on youtube, you are expected to sue the uploaders. If you don't, that's pretty much a given that you're not using the DMCA the way you're supposed to. By law, youtube has to share the takedown letter to the uploader (and they do), so that they can prepare for a lawsuit or counter-suit as the case may be.

Don't get me wrong. The DMCA was a horrible piece of legislation that proves that lawmakers are lazy, incompetent, and just plain out of touch with how the majority of this country thinks. But there's some teeth built into the bill to keep it from being used as a way to stifle free speech. If you're caught misusing the DMCA, you expose yourself to both legal and civil damage. If you cannot pay for your false claims, you can have an injunction placed against you from filing any further DMCA claims.

Children See. Children Do.

silvercord says...

We're the ones to set the example - don't need anything else besides our common sense to distinguish wrong from right. We're the ones that set the example.

Visit the National Association for Prevention of Child Abuse and Neglect (NAPCAN) for more information.

Credits

The Children See Children Do campaign was developed pro bono at DDB, Sydney, by creative director Matt Eastwood with creatives Charlie Cook and Simon Johnson, and agency producer Sean Ascroft.

Filming was directed by Sean Meehan at Soma Films who host Children See Children Do as a 5.56 mb SWF video. See Soma Films’ earlier work for NAPCAN - Don’t Just Stand There.

Editing was done at Winning Post, who host Children See Children Do as an 11.9 mb quicktime video.

NAPCAN worked with DDB to raise awareness of all adult Australians that responsibility for children’s wellbeing goes beyond parents and child care professionals.

Children’s Guardian were involved in filming to ensure that children were not exposed to harm in any way. The domestic violence had adults and children filmed separately then placed together in post production. The girl with the cigarette had her cigarette and smoke added to her shot in post production.

Soundtracks

There are two songs used in the NAPCAN ad. The Soma Films online version has "Rabbit in your headlights", sung by Thom Yorke for Unkle. The NAPCAN online version has a song, written and performed for the campaign, with the lyrics, "It looks like rain again today, dark clouds gather, fill the sky. Don’t know how to talk to you, just know how to say goodbye."

... because there are just way too many on a site that has such a broad range of users from different countries.

Hello, Canada calling. They seem to really hate us up here in the land of "it's not available in your country, but we broadcast it in parity on TV." Still haven't quite figured that one out, but agreed 100%

They probably haven't found advertising sponsors who want to promote to the Canadian market through web based showings, and nobody is keen on footing the bill of the bandwidth pro bono. Either that or whoever owns the distributing rights to it in Canada thinks they can juice you viewers over there for more money without an online alternative.

Actually ... wait isn't there some Canadian Comedy Central site where you can watch it already?

How to use Excel's VLOOKUP function like a rockstar

mrk871 says...

^ Agreed
I've seen Slash using that F4 trick.

Bono is really good at charts and pivot tables, but gets bogged down by long embedded formulae so he does a calculation in stages and just hides the columns.

Although the real master of the HLOOKUP is of course Bruce Springsteen who really knows how to work his functions. There's nothing quite like gathering round his cubicle and watching the boss at work.
