I'm curious to know how this has affected the creditability of the pediatrician, etc that stated she was a child just based on what they seen in the video. Granted, the pic of her did look like she was a preteen, but still...you'd think a prosecutor team would at least ensure some verification rather than "expert testimony" stating "Oh yeah...I've seen plenty of kids. Thats totally a kid."

Which is fine, I suppose, if there is some sort of repercussion when you're proven wrong...and these folks were obviously proven very very wrong.

What I find most troubling is that this case went forward without any evidence that she WAS underage. Keep in mind that Puerto Rico is part of the US from a Federal perspective, it is part of the first-circuit which is based out of MA... Kinda scary that you can get brought to trial just because someone THOUGHT the actress looked underage.

I'd guess her to be under 16 just by the way she communicates. Maybe it'll give reasonable doubt around the world now...since they can point to this as an example. Still, if the prosecution in this case had a 90% conviction rate as this guy claims and they do similar things in other cases, expert testimony on things people can't possibly know conclusively...that's a shady bunch.

Let me jump in here... Evan is a good dude, I've shot him several times and he has been in the biz for YEARS, he was married to another porn star, you may have heard of her, Tera Patrick! The guy is a WORLD CLASS PROMOTER, so I wasn't surprised to see him take advantage of this "news" story to promote his website, her website, his brothers website...you get it.

But it is a dilemma when you think about it. If you are going to have laws against the possession of child pornography, you almost have to rely on "expert" guesses at age. Since the vast majority of kids appearing in actual CP could never be tracked down. In doing so you risk this kind of horrible miscarriage of justice. If you don't do it, CP laws become nearly unenforceable.

Making it even more confusing is the fact that skinny petite girls like that may not even have even hit puberty by the age of 18. http://en.wikipedia.org/wiki/Female_puberty#Timing_of_the_onset_of_puberty

And it doesn't help that she was almost certainly chosen for her underdeveloped body, then dressed up to make her look as child-like as possible.

Still though if someone could track her down as easily as just looking up her Myspace page then I suspect they didn't try very hard to find her for verification. I'm not sure how the system works now but I think there should be consequences if the prosecutor doesn't make sure they've got all the facts straight, especially if they had actually managed to get a conviction. More than likely though they probably didn't give a damn whether he was really guilty or not and just wanted the conviction.
