Police Brutality in Victoria, BC.

An out of control cop in Victoria BC literally kicks the shit out of 2 compliant suspects. I don't want to hear any apologists posting comments like "The video doesn't show what happened before". There is no excuse for what we see here.

8 people were apparently fighting outside a bar in downtown Victoria, 3 police officers broke up the fight and attempted to arrest those involved. This video obviously captures events near the end of the incident. All those involved in the altercation were released with no charges. Victoria Police started an investigation into the conduct of their officers as of today, March 23 2010 after the video started making the rounds on the net.

Disgusting, and embarrassing. No excuse for crap like that. BC is a great place, but I'm sad to say our police have quite a reputation for being corrupt, violent douchebags.

It's nice that ever present camera phones can catch this abuse of power, but these guys never pay for it anyway.

The video isn't clear enough to understand if the first kick was justified. The second kick on the second individual, however, seems like it could be justified. When the man was told to lay on the ground and put his hands behind his back, he refused to do so. Even when one officer was attempting to get the individual to put his hands behind his back, the individual resisted and struggled to keep from being arrested. I don't know if the arrest itself was justified, but that is completely besides the point. When you're given an order by law enforcement and you don't comply, they have the right to increase their level of force according to the matrix of force they are taught in the academy. If the second individual didn't want to get kicked in the ribs, he should have followed the directions of law enforcement from the beginning and not resisted arrest.

We must be watching different videos. From my vantage point it looks like he was complying fully and Officer Baldy kicked him in the gut just as his hand was being cuffed. It also should be pointed out that the Victoria cops are specifically trained against and prohibited from using a knee to the back- which Baldy does twice. That technique breaks ribs and spines.

It's been announced this afternoon that there are now two investigations into the conduct of officer baldy- who has been suspended to desk duty. One internal investigation by Victoria police and one by the Vancouver PD. I should point out that Jamie Graham, now Chief of Police in Victoria was Chief here in Vancouver until he resigned due to pressure surrounding a misconduct investigation.

No wonder we're all so cynical that justice will ever be done when it comes to Police violence and corruption.

Cases where kicking someone in a place that could potentially hurt them badly, such as the head or ribs, would to me include: They are actively attempting to hurt anything that can feel pain whether it be an officer, civilian, or a dog/cat/whatever. Or they have just committed an act of harm against another. Guy in video at the end appeared to ask a question, then uniform officer tells him to get down, they both jump on him and he appears confused by one cop answering questions like he's a person and the other screaming like he's a criminal.

The guy at the last part of the video isn't complying but I can't tell if he's saying something or not. Or if he's just too drunk/stoned or scared or mentally handicapped. Personally if I just watched them beat someone else, I don't think I'd want to have my hands strapped behind my back and take the risk of them deciding to kick me too.

If two police officers can't wrestle the guy down and get his arms behind his back with their combined strength, then they should hold him at gun point or taser him because he's too much for them to handle and call for more help.

Unless they've had to arrest this guy a dozen times before, they simply don't know if the guy is medically messed up in the head or physically where beating him isn't going to change his ability to understand or perform their actions.

My brother is mentally challenged enough that he is very slow to react and often times doesn't comprehend many requests or commands made of him until you repeat it a different way or show him. Or if he's scared/caught off guard, he just stops processing completely and it looks like he's trying to be a smart ass because he just gives you a blank stare. He also has epilepsy. He was told by an officer to put a brightly colored card in his wallet stating his name/address/medications/medical conditions so he could give to officers if something were to occur. It doesn't do any good when they are ready to throw you to the ground the minute you reach into your pocket, especially when you just don't understand the situation like my brother often has problems with. He tries to be compliant, but most cops won't give him the chance or try to explain because they just assume they have a trouble maker on their hands and get ready to "handle it". Bottom line is, people have problems you can't often tell by just looking at them. Not all mentally handicap have physical characteristics to distinguish them. Most people don't realize it about my brother until they've spoken with him awhile or I tell them before hand, they just assume it's shyness or social awkwardness.

No one should be kicked in the head or ribs. I can understand kicking someone's legs out from under them, or kicking their arms/hands away from their body to keep them from reaching for stuff.

And I may be mistaken, but it appears the non-yellow jacket officer at the end is smiling. That is not a situation where most people should be smiling. I could see if the guy is just crazy as hell, but not after your buddy has kicked him a couple times and you just had problems getting him to obey your orders.

I don't beleive kicks are justified at any point unless the officer is fending off an attacker, which this was clearly not. This is why they go to police training to learn submission holds and pressure points; its knowledge to safely take control of the people and the situation, safely for both the cops and suspects. This just escalates and promotes violence rather than stopping it. Watching that predator hand weapon video makes me wonder why cops even need to use excessive force that could seriously hurt or kill someone (even though they might be breaking the law, its not worth killing someone over a bar fight)when they could just use the predator to quickly force someone to submit. A hard full force kick to the torso is not the answer.

He should obviously be tried as a violent offender and even more, abuse of power. Like the porn industry, the policing industry has a tendency to attract the wrong types, who abuse, defile and destroy - clearly this is one of those. This does not mean that police in general are bad.

Victoria police issued a statement about the incident on Tuesday.

"At around 12:30 a.m. three officers on foot patrol witnessed a fight involving eight males and saw a victim of an assault lying on the ground being kicked in the head by a suspect," the statement reads. "The officers eventually wrestled six people into custody."

"The victim found lying on the ground was rushed to hospital with a head injury, he was treated and released and is refusing to cooperate with police. The combatants were all released without charges approximately 45 minutes later."



One of the field goal attempts, Harpinder Kang, plans to sue the police. Unfortunately for him, Canadian courts don't work the way they do in the States.
