D.C. detective pulls a gun when his vehicle was hit with snowballs during a flash mob snowball fight.

"Fuck you pig" is protected by the 1st. It's an expression of discontent with the officer for his reckless endangerment. However it could be argued that "Fuck you pig" are fighting words. It depends on how the judge is feeling or in the case of a jury their demographic.

The guy obviously didn't want to partake in the snowball fight. If people are throwing snowballs at him, he'd be correct in interpreting that as assault. Pulling his gun was probably his best option to get them to stop short of physical restraint. If he'd pointed it at anyone, that would have been stupid. But a person should be able to walk around in public unmolested, with a gun to back that right up. I don't think it was brandishing, and if any of those idiots sue him they should get slapped with a fine for assault. What a mob mentality.

It may be protected speech, but that doesn't really matter in the end - it's not smart at all.

Drawing his weapon and just holding it there does seem kind of dumb and menacing. I'm sure he felt threatened, but ID yourself as a police officer and if they continue with the assault then arrest them...and even draw down if needed.

Pulling a gun is a class 3 Misdemeanor and can be interpreted as intent to cause harm. Depending on what state you are in this can get you shot by another person with a gun. One state over, Virginia, is an Open Carry state as well as a conceal friendly state. Pulling a gun with out visible identification that you are an officer can lead to terrible things, and quiet possibly a shit bag.

Pulling a gun was not the first thing to be done. You are not familiar with the force continuum are you? Let me explain.

Do you know why the use of a fire arm is the last straw? Because you should never have to use your fire arm. Going straight to the fire arm is a way for the untrained, and the power hungry to exercise their stupidity.

If a regular citizen cannot carry a weapon concealed in the district then neither should a cop.

Apparently the folks with scarfs were "anti-war protesters dressed in anarchist garb" and that innocent detective "pulled back his jacket, exposing his service weapon [and] it's unclear if he did this intentionally". In fact, the only drawn gun mentioned in the article is the uniformed officer responding to a 911 call about an armed man.

Of course in the video you can clearly see a gun in the detectives hand.

You definitely have to commend the uniformed officers for their handling of this incident. That detective, on the other hand, should be crucified. Doubtful he'll even get a warning.

My point exactly, thank you. I forgot to mention the fact that the other officer could have killed the man for having a gun.

If I were put in that situation the detective would have been treated as a suspect, and handcuffed. Any one with a weapon is treated this way, because they are a threat to public safety, and you can never be sure that the detective isn't a fake. Sounds cliche, I know, but its just how it works.

The officers did not do their jobs in controlling the rogue man with a gun.

Conduct unbecoming.

It must be nice to be white in DC. To be able to throw a snowball at a cop, to be able to yell "fuck you pig" at crowd of cops, to be able to get in the face of a detective and yell at him like a child. Must be great. For anyone else, that would have been *eia behavior.

I think the cop is wrong too, but it's amazing to me that the most unruly in the crowd didn't get beaten, shot, tasered, handcuffed. Apparently the police state hasn't reached everyone yet.

What this guy did should have nothing to do with his being a cop. Other than the fact that the other officers arriving didn't put him in cuffs right away(the radio in his hand indicates he was talking to dispatch), this could have been any other citizen. While I think he may have escalated the situation a little quickly, the next option past verbal command is physical action, which this guy didn't do. He simply displayed a firearm, which is PERFECTLY LEGAL. He never threatened to shoot anyone, or abused any police power. The fact that he was a cop has nothing to do with his actions or that of the crowd. FYI a snowball to the head can hurt like shit, I sure as hell don't want to get hit by some stranger who thinks it's funny.

Actually, since this is DC, and they hate handguns, he may have broken the law, and if so then he's pretty stupid being a cop, but he should have every right to defend himself in public and not put up with punks throwing snowballs. Shooting them would be a bit too far, but simply holding a gun? nah.
