Logically no matter what it should be truck owner. He/she is responsible first and foremost because proper maintenance is the owner’s responsibility and your wheel coming off is proof of improper maintenance.

If they could prove a shop mounted the wheel wrong….forgot lug nuts, used broken studs, put the nuts on finger tight…they could likely sue, but proving that would be impossible without close up video at the shop of the faulty parts/installation.

#3 is possible, but only after proof of a known design flaw that makes the wheel come off is established. Good luck. This is what Tesla is up against with their self driving software, but only after multiple deaths and many crashes.

Most aftermarket parts have limited liability clauses limiting their liability to replacement of the defective part, not even labor. I know my lift kits had multiple warnings and liability releases in the instructions/warranties. Not total immunity if they intentionally sell dangerously defective parts, but definitely a difficult thing to prove.

I’m not a lawyer, but I have them in the immediate family (grandpa), so I have a little bit of an idea how this usually works in court.

1. Freak accident, no one is liable.
2. Truck owner is liable, but only because they modified their car from manufacturer spec?
3. Truck manufacturer is liable, faulty construction?
4. State or federal government is liable because of something in the road that make the truck's tire fall off.
5. After market kit provider or after market kit installer is liable because their modification lead to the failure that caused the tire to come off.

I wonder how it all worked out.

They left out the Tesla Semi truck that has a minimal (300 mile) range, <2/3 the load capacity, and costs >3 times what a similarly equipped semi tractor costs. Then add in the inconvenience of having to find a proprietary Tesla fast charging station that fits a semi truck instead of a gas station/truck stop.

They also didn’t know the self driving feature was recently recalled and Elon fired the department that codes the software because they considered unionizing when they made this video….horrific timing Elon.

None of this is worse that Elon turning on his customer base at the same time better options are coming on the market that don’t put money in an extremist racist Trumpist nightmare’s pocket. That, more than anything, is a danger to Tesla’s viability. Never tell your customers you absolutely hate them. I don’t think that strategy has ever worked out.

That’s Tesla’s position…but no.

The man had been complaining about the brakes not working properly for months according to his family (yet kept driving, making him culpable imo).

It’s easily possible his brake sensor failed on the pedal, then there would be no light. Since I assume, to be capable of autopilot, Tesla brakes are by wire/electrical, not hydraulic, a simple sensor failure means no brakes at all and no brake lights. (And no record that he hit the brakes)

Again, never once heard of a panic pedal misidentification lasting 1/2 that long. Possible, but unlikely. 99/100 of pedal misidentification are well under 1 second mistakes during parking. There have been many reports of throttle sticking/ accelerating without throttle input in teslas.

Since Tesla denies fault EVERY TIME NO MATTER WHAT, and hides the vast majority of driver assisted crashes, I’ll wait for the third party investigation, but on the surface, to me, it looks like a software (or hardware) failure….and that’s what the driver says too.

Also, one of the voting machines that the Republican candidate for Michigan AG stole and tampered with after the 2020 election was just sold on eBay by a man who bought it from Goidwill. His group called Republican clerks claiming to be Republican representatives who needed to inspect voting machines for fraud, and the clerks were happy to turn them over without any paperwork or verification of who they gave them to. His team then disassembled them in air bnbs and hotels (didn’t want their homes or offices to be part of their crime spree) tampered with them, copied the software and photographed (and more) the hardware. The AG has said these machines were damaged, tampered with, and in some cases “lost”. The Republican that led this scam/fraud/election interference is now the Republican candidate for AG.

Bad news, Ford just announced they give customers a right to repair their own vehicles, unlike Tesla.

Tesla keeps its tech secret, uses proprietary tools they don’t sell, and goes the extra mile to make sure only Tesla service centers can work on a Tesla, allowing them to charge $15000 for repairs that should cost $700 (and do at the few after, aftermarket Tesla repair shops). This is because Tesla is a software company like Apple, and tries to use the same hyper control scheme that Apple does….essentially saying you just rent your Tesla, it’s not really yours to modify or repair.

Ford designed its crate motor, now available for aftermarket projects btw, the same motor in the E-mustang and soon in the e-f150, to be simple to work on with normal mechanics tools. They’ve indicated a willingness to make their systems open source so anyone can fix them. This is going to make Ford a much better choice even if their specs don’t measure up, and it seems they will.

Sorry, @bobknight33, it’s not looking great for your “all in on one stock” plan. So you understand, in order to be a good deal, Tesla stock still needs to drop by 4/5…or down to around $150 +-. That would put its PE ratio around 20….still high, but considered decent these days. 100 PE is just insane.

It would require a fairly intensive refactor to get it to work. The hardest part would be figuring out how to shoehorn GOTO into a modern BASIC interpreter since that command was taken out back and shot in the head -- and for good reason -- but with the memory and processor restrictions of computers at the time, GOTO was necessary because GOSUB required 4 bytes of stored information and a bit more processing power. There's also a number of functions that are exclusive to TRS-DOS BASIC and the Model III in particular.

At one point, I thought about moving the code from BASIC to Z-80 Assembler, but by then the first PC Jr. clones were out (I had a TRS Model 1000 and it was GREAT!) and it no longer made sense to continue doing anything on the Model III.

The worst loss is the database data, which was all the room and pathing descriptions, as well as part of the warm storage for the games. That's the part that breaks my heart to have lost.

That said, the sound over an acoustic coupler of an analog modem making a 300 bps connection is still makes me smile.

He's currently working on a crypto-currency-esque gaming system where block chains are used to issue an artificial limit on the number of software copies that can be used at one time....because I don't have a shit ton of games with zero players already.

MAYBE if they limit players for the new diablo 2 remake to ??? how many? or why? the addition of this to something like the number of copies of a game is like a poison pill in my mind. One of the awesome things about software in general is that i CAN make copy copy copy and it's an EXACT duplicate of what is stored in a different location.

So then....Why won't republicans accept an honest vote count?

Arizona finished ANOTHER recount, the Republican recount of Maricopa county finished last week, but because it had the same results as the first one, the second one, and the third, Trump lost big time, Republicans are already planning another one....the problem, all the voting machines are now officially invalidated because cyber ninja tampered with them during their second (or is it the third) audit, and they are no longer secure or unadulterated. They cannot even be used in the future because it's impossible to know what they've done or how they tampered with the software and hardware. I must assume this was the plan all along, keep recounting and auditing until they digitally change the votes, and only then accept their own recounts..

So, again, the true question is, why won't Republicans accept a mostly honest vote system they themselves put in place and ran and they themselves certified nationwide repeatedly? Why won't you accept the results of multiple counts and audits that all come to the same conclusion, the counts are valid and there was no significant fraud.

If a hacker breaks into a company, or its software, and reports the breach to the company, the hacker often gets a bounty. It's not the hacker's job to think about how to fix the problem - although s/he may: it's the company's.

Yes, maybe she daughter is in trouble - but, if so, this would be due to the school's reaction.

I knew about the "planned obsolescence" of bulbs and nylon stockings, but this video had more details.

I gotta call B.S. on the "everlasting LED bulb" comment he makes at the end. I've had many LED bulbs fail after 2 years when they are supposed to last at least 8. Most of them Feit brand. Sure I could request a warranty replacement, but I'd have to pay shipping both ways, which costs more than getting a new one.

Apple has had class-action battery lawsuits almost every year since the iPod introduction. I did take advantage when they had $30 battery replacement for iPhones, but guess what - that's gone back up to "overpriced" as of last year. At least they support iOS devices with 5 years of software updates. Google has always been worse, and some 3rd party (HTC for example) ship new Android phones (at least their cheaper non-flagship models) with outdated software, and never release a patch.
