^ yep, welcome to the age of retardation. You may as well also charge an underage person with child pornography every time he/she gets in the shower.

There are numerous cases just like this one, although I recall there is something called a "Romeo and Juliet" law some states use to use that provided for couples who are underage not to be charged with child molestation, although that gets hairy once one partner turns 18. Sounds like Penn has no such provision.

Taking it a bit far maybe? They are talking about the rape of children under 12 years, not some kid held back a grade who is still dating his high school sweetheart. Seems like a lot of places have "Romeo and Juliet" laws for that sort of thing. As far as the constitution, do you mean the cruel and unusual punishment thing? As in the punishment should fit the crime? One could argue that someone who rapes a 5 year old takes away their childhood and causes irreparable harm that can damage all future relationships...isn't that kind of cruel and unusual?
