When a Lawyer Insured His Cigars Against Fire

newtboy says...

My guess was their lawyers told them in order to win they first had to prosecute, and they had to pay off first to make burning cigars a crime, then recoup all their losses with restitution in the criminal case…without the arson/fraud charge proven they might lose the case, thereby setting the horrific precedent. Ain’t laws fun!?

I’m just surprised there weren’t 20 charges of insurance fraud too.

While your statement can be taken as fact, this story however is based on this legend: https://www.snopes.com/fact-check/cigarson/.

The Snopes article itself is from 2000.

Rarely are lawyers THAT stupid (those that are, gets appointed as judges by the likes of Trump to do the Republican's biddings), nor are insurers that passive in NOT fighting it out in court. They don't want these precedents to stand.

Cop Pulls Over Top-Ranking Officer for Speeding

96 in a 35, nearly triple the speed limit in a rural/residential area!?!…that’s 100% dangerous reckless driving. He intentionally drove in an outrageously unsafe manner with wanton disregard for the safety of persons or property….under color of authority to boot! That should make this a felony with a 5 year sentence.

Any citizen caught would go directly to jail with the car impounded for a week minimum (after getting beaten up and tased), and sentenced to 5-90 days, $1000 fine, two or more points on their license, cancelled insurance, and loss of employment if they drive for their job.

He gets a ticket he won’t even pay, no thought of impound, and two days of extra vacation (“without pay” means they use sick time, vacation time, overtime, or Flex Time…they still get paid in full, they’re just not on the clock for 2 days.)
His passenger in uniform didn’t even get a reprimand for doing it with him. He should also see prison.

It’s time for citizens to citizens arrest these criminals, deadly force is authorized if they resist.

Under DeSantis insurance rates have gone up by over 200% in 5 years to well over $4200 a year, 3x the average….if you can get any with major insurance companies fleeing gulf states or going bankrupt….but sure, climate change is a hoax and conservatives manage their states well. 🤦‍♂️

The fourth major insurance company (Farmers) is leaving Florida, with 6 medium sized companies going under in the state in the last year…all because of that non existent global warming that isn’t happening and the costs that therefore aren’t involved. Many others have stopped selling new policies.
DeSantis blames wokeness….so I guess capitalism is woke now. Enjoy being a communist. The biggest insurance company in the state are now the socialist government policy writers. 😂
Good thing it’s all a hoax…you can buy cheap uninsurable oceanfront land and retire. Go all in, it’s the only way to invest.

Meanwhile ocean temperatures right before hurricane season are in the mid 90’s…but that won’t cause more hurricanes or sargassum because it’s not real…hoax hoax hoax! 🤦‍♂️

Man Rips Up His Cash Over Seat Belt Ticket

newtboy says...

I don’t understate or underestimate the impact or cost of obesity, I only point out that no one else has to directly pay for your care because you got fat by your own choice, but others might and often do foot the bill for the irresponsibility of not wearing a seat belt.
Discounting is a partial fix….by how much? How do they decide how much worse your injuries are because you didn’t wear a belt…and who decides…and what’s the cost of doing that math? I’m perfectly fine with people not being safe as long as they accept 100% of the risk….it should be wear no belt, get no injury recovery (or insurance coverage) period. Anything less makes the case for seatbelt requirements imo.

Quick google search, since I never really looked at the legal liability side pf this issue before.

Some states actually hold drivers accountable for not wearing their seatbelts and discount the payout for injuries, others don't allow insurance companies to consider whether the driver was wearing a seatbelt or not when looking at their injuries. (California discounts, Pennsylvania doesn't)

I think you are understating the societal impact of obesity compared to drivers getting more badly injured without seatbelts. To be clear I don't think the government should be regulating either.

Perhaps not, but we don’t live in a free society, nor a responsibility free society.

The effects are not low. The difference in cost of a serious car crash with and without seatbelts is in the hundreds of thousands to millions of dollars.

Again, because you can be “at fault” through no fault of your own, and responsible for all injuries the other driver suffers, it’s not just smart but the only responsible move to be forced to wear them and minimize the shared risk.
It’s 100% unfair for the other driver to be allowed to take the high risk of not wearing it but you have to pay for the consequences of their irresponsibility….don’t you think?
The difference here as opposed to, say, obesity is the risk/consequences of the irresponsibly transfer to others regularly and often completely (at least financially).

If not wearing it was an automatic waiver for any and all bodily injury damages, fine, but it isn’t so being forced to wear it is the only sane and rational move. Because that choice can turn a no damage bump into injuries requiring life long care

Tesla Cam captures INSANE crash

Not an expert, but it could be a domino effect of a loose screw scenario, causing all the screws to be snapped off. Here in Toronto (Canada), we've seen significance increases of fatal accidents of these type because of (mostly truck's) poor maintenance causing wheels flying off & killed people. It's the driver's (or trucking companies') fault. The interviewed Police usually warn viewers that because we here often need (and should!) change between summer/winter tires, we need to make sure the tires are balanced and the screws are properly tightened. The garages usually wash their hands off from accident liabilities and insurance companies rarely go after the garages as well.

I hope everyone escaped without long term injuries.

I wonder how liability works in a case like this.

Possible scenarios:
1. Freak accident, no one is liable.
2. Truck owner is liable, but only because they modified their car from manufacturer spec?
3. Truck manufacturer is liable, faulty construction?
4. State or federal government is liable because of something in the road that make the truck's tire fall off.
5. After market kit provider or after market kit installer is liable because their modification lead to the failure that caused the tire to come off.

I wonder how it all worked out.
